It appeared from the evidence that the place had been reported dangerous, and the mine manager’s attention was called to it; after examining the timbers the mine manager thought there was no danger for that day, stating that he would replace them with new ones at night. During the afternoon, about 2 p. m., deceased was hitching his mule to a loaded trip, when the rock fell on him, with the result as stated.
