Lawrence County Illinois Probate Record-FHL #1311895 Record of the Last Will And Testament State of Illinois In the Lawrence County County Court. In Probate, June Term, A. D. 1883. On Friday, the Twenty ninth day of June in the year of our Lord one thousand eight hundred and Eighty three Present: The Hon Philip W. Baines Judge J.W. Calvert, Clerk. And Edmund Ryan, Sheriff In The Matter Of The Estate of Margaret Sumner Deceased. This day comes A. Q. Baird and makes due proof to the satisfaction of the Court of the death of the said Margaret Sumner late of said County of Lawrence which proof is ordered by the Court to be entered of record. Thereupon comes Jesse P. Jones and surrenders to the Court an instrument of writing purporting to be the last will and testament of the said Margaret Sumner, deceased, which is ordered by the Court to be filed. Subsequently, also come A. Q. Baird and W. D. Gelpin, subscribing witnesses to the aforesaid instrument of writing, and being first duly sworn, testify to the due execution of said instrument by the testratrix said Margaret Sumner deceased, and their attestation thereof according to law, on the day of the date thereof, as and for the last will and testament of the said Margaret Sumner deceased, and that at the time of the execution of said instrument, said witnesses belived said testator to be of sound mind and memory and under no constraint, which testimony is ordered by the Court to be entered of record is full. And also comes Jesse P. Jones named as executor in said will, and takes and subscribes the oath required by the Statute in such case made and provided, which oath is ordered by the Court to be entered of record. And the Court being fully advised in the premises, it is ordered that the said instrument be and the same is hereby declared to be duly and sufficiently proves and authenticated as the true last will and testament of the said Margaret Sumner, deceased. And it is further ordered by the Court that the said will be entered of record. Philip W. Baines, County Judge of Lawrence County Proof Of Death A. Q. Baird being duly sworn deposeth and said That Margaret Sumner late of the Town of Christy in the County of Lawrence and State aforesaid, departed this life at Mrs. Lucas' in said County, on or about the twenty first day of June A. Gelpin subscribing witnesses to tha annexed instrument of writing, purporting to be the last will and testament of Margaret Sumner late of said County, deceased, who being duly sworn according to law, do depose and say, each for himself, that they were present and saw the said Margaret Sumner sign said Will in their presence and that they believe that the said testatrix was of sound mind and memory, of lawful age, and under no constraint when they signed said will. In the name of God, Amen: I, Margaret Sumner, of the Village of Sumner, County of Lawrence, and State of Illinois, of the age of eighty two years, and being of sound mind and memory, do make, publish and declare this my last Will and Testament, in the manner following, that is to say; First. It is my will that my funeral expenses and just debts be paid in full. Second. I desire and instruct my executer hereinafter appointed, to convert all my property, both real and personal, except as I herein depose and bequeath, into money=And for this purpose I empower and authorize my Executer, to sell the same, either at public or private sale, as he shall deem best, and to the best interest of my heirs. I hereby fully empower my Executer, to execute conveyances to any and all my real estate, where sale is made, to carry out this my will and desire. Third-I will and bequeath unto all my nieces and nephews, and my brother, Seth Umfleet, unto each, One Dollar, ($1.00) - To the two children of my grand-daughter, Margaret Moore, each, One Hundred Dollars. To Laura Turner, Two Hundred Dollars, my bed and bedding--To A. H. Umfleet and Sarilda Elston, each, Twenty Five Dollars - Fourth-After the payment of the above, I will and desire my remaining property or money, and bond or dairies, to be equally divided, so that each of the following to share and share alike, namely-Charles Lucas, or his heir-John Lucas, Albert Lucas, Joseph Lucas, Edward Lucas, James Lucas, Ann Lucas, Mary Jane Lucas, their mother, and Laura Turner, the following sons of Levi Umfleet, deceased, Viz; Benjamin Umfleet, Jackson Umfleet, Pleasant Umfleet, to share alike as aforesaid= And Lastly, I constitute and appoint Jesse P. Jones, Executer of this my last Will and Testament-And I hereby make and declare void, and of no force, all will or wills of a former date. D. 1883 I Do Solemnly Swear, that this writing contains the true last will and testament of the within named, Margaret Sumner deceased, so far as I know or believe, and that I will well and truly execute the same by paying first the debts and then the legacies mentioned therein, so far as her goods and chattels will thereunto extend, and the law charge me; and that I will make a true and perfect inventory of all such goods and chattels, rights and credits, as may come to my hands or knowledge, belonging to the estate of said deceased and render fair and just account of my executorship, when thereunto required by law, to the best of my knowledge and abilities, so help my God.
