Order Admitting Will To Probate And now upon this twenty-eighth day of October A.D. 1921 this cause comes on to be heard upon petition of Jacob Lauer duly verified and filed herein, praying that a certain instrument in writing, also filed herein, be admitted to probate in this court, as the Last Will and Testament of Henrik Bock deceased, who, in said petition it is alleged, departed this life on or about the tenth day of September, A. D. 1921 being at that time a resident of the aforesaid county of Logan and having his surviving the following named persons, with relationship to deceased and places of residence, as far as to petitioner known, as his only heirs at law, legatees and devisees: Katherine Bock, widow, legatee and devisee, Lincoln, Ill; Adam Bock, brother, Seventh St., Lincoln, Ill.; Carolina Wilmert, sister, Atlanta, Ill.; Minnie Lawn, sister, Greenview, Ill.; Elizabeth Apel, sister, Lincoln, Ill; Mary C. Lauer, niece, Lincoln, Ill.; William A. Gosda, nephew, Atlanta, Ill.; Henry J. Gosda, nephew, Manito, Ill.; George G. Gosda, nephew, Blabon, N. Trier, Germany – Unknown Heirs and Direct Descendants of Jacob Conrad, legatees, residence unknown Unknown Heirs and Direct Descendants of Friedrick Conrad, legatees, residence unknown Unknown Heirs and Direct Descendants of Phillip Conrad, legatees, residence unknown Unknown Heirs and Direct Descendants of Caroline Hass nee Conrad, legatees, residence unknown Unknown Heirs and Direct Descendants of Margaret Schneider nee Conrad, legatees, residence unknown Unknown Heirs and Direct Descendants of Luise Kohl, legatees, residence unknown And now the Court doth appoint C. Everett Smith, a practicing attorney of this Court, as guardian ad litem for the unknown minor heirs and minor direct descendants of Jacob Conrad, Friedrich Conrad, Phillip Conrad, Caroline Hass nee Conrad, Margaret Schneider nee Conrad, and Luise Kohl aforesaid, for this hearing, whereupon comes the said guardian ad litem and files answers herein. And it now appearing to the court, from the proofs herein made, that the names of all the heirs, legatees and devisees of said deceased, and the respective places of residence of each, are in said petition correctly stated, except the heirs and legatees aforesaid, whose names and post-office address are alleged in said petition to be unknown, and that the clerk of this court did, within five days from the filing of said petition and not less than twenty days prior to the day heretofore set by this court for hearing on the same, send a copy of said petition, together with a notice of the time and place of said hearing, by mail, postage prepaid, to each of said parties, named as heirs and legatees in said petition, addressed to them at their respective places of residence as in said petition shown. And it further appearing to the court, from the proofs herein made, that as to the heirs and legatees aforesaid, whose names and post-offices address are alleged in said petition to be unknown, notice by publication was given, for at least three weeks before the day heretofore set by this court for hearing on the said petition, in the Lincoln Daily Courier – Herald, a secular newspaper of general circulation, printed and published in the aforesaid county of Logan, and regularly published therein for at least six months prior to the first publication of said notice, said publication notice having contained the names of the testator and his heirs at law, legatees and devisees, where known, and the time and place when and where said purported Will would be offered for probate; And it now appearing to the court, from the proofs herein made, that the said Henrik Bock departed this life on or about the date in said petition alleged, being at that time a resident of the aforesaid county of Logan, and that due notice of the pendency of this proceeding has been given to all the heirs at law, legatees and devisees, in manner and form as by statute in such case made and provided, the court doth find that it has full and complete jurisdiction to hear and determine the cause. And now on this hearing comes Joseph A. Tabke and Donald McCormick who appear to be credible witnesses and declare on oath before the court that they were present at the execution of said purported Will and saw the said Henrik Bock sign the same, that in his presence and at his request, they signed the same as witnesses thereto and that they believed the said Henrik Bock to be of sound mind and memory and under no restraint at the time of signing the same. And now the court having heard the evidence and proofs herein and being sufficiently advised in the premises, doth find that the said purported Will, has been duly proven, that the sand was duly executed and attested according to law, that there is no proof of fraud, compulsion or other improper conduct exhibited herein sufficient to invalidate or destroy the same and that at the time of the execution of the same, the said Henrik Bock was of sound mind and memory and under no restraint. It is therefore ordered, adjudged and decreed by the court that the said instrument be and the same is hereby admitted to probate in this court as the Last Will and Testament of Henrick Bock deceased, and that the same be entered of record herein. And it now further appearing to the court that Jacob Lauer who is named and appointed in said Will to be the executor thereof, is a resident of the State of Illinois and willing to accept said trust, it is further ordered by the court that the said Jacob Lauer be and he is hereby appointed and confirmed as executor of the said Will, upon entering into bond as such, in the penal sum of $25,000 with securities approved by the Court and taking the oath provided by law. And now comes the said executor, appointed as aforesaid, and having taken the oath provided by law, now presents to the court his said bond in the sum aforesaid and the same is by the court hereby approved, whereupon it is further ordered by the court that the said bond be filed and recorded and that letters testamentary issue to the executor appointed as aforesaid. And now comes the said executor and fixes upon the January A.D. 1922 probate term of this court for the presentation and adjustment of claims against the said estate, which action is by the court hereby approved.
