Albert Montgomery being duly sworn, deposes and says that David Montgomery, late of the County of Logan and State of Illinois, died intestate on or about the 20th day of May A. D. 1860, leaving no widow and the following named children, to-wit: Albert Montgomery, Edwin Montgomery, and Mary C. Montgomery and that the personal estate of said deceased is worth about $400.00. Albert Montgomery Subscribed and sworn to before me, this 18 day of June A. D. 1860 John Jenkin County Clerk Atlanta, May the 15 1860 I Being in a bad state of health but being in a state of mind capable of doing my own business I Bequeath unto my son Albert and my daughter Mary all my real estate and all so my personal property. My son Albert to agree to sell all of my gifts dues and demands. Edwin my oldest son I gave unto him his share of the estate in money in the year 1854.
