I Sinnet Rankin of the County of Logan and State of Illinois, being in good health and in sound mind and disposing memory, considering at my present age the uncertainty of this frail and transitory Life, do hereby make, publish and declare this to be my last Will and Testament: First, I order and direct, that my Executor hereinafter named, pay all my just debts and funeral expenses, as soon after my demise as convenient. Second, I give and bequeath to my wife Eliza H. Rankin - The Family Pheston, Horse Harness and belongings together with all the House hold furniture that I may die seized of. Thirdly It is my will that my house and lots Corner Lincoln Avenue & Clay Streets in Lincoln, Ills be sold and that one third of the proceeds be given to my Grand daughter Emilie Albertine Ary in addition to her share in my Estate as hereinafter provided. Should I however dispose of said Lincoln Avenue property before my death, then and in that case I order and direct my Executor to pay the sum of One Thousand Dollars to her in Lieu of the above one third of said proceeds of sale and in addition to her share as mentioned. Fourth - I name as my heirs, besides my wife Eliza H. Rankin, my five grand children to wit: 1. Annie E. Ashurst, wife of Robert S. Ashurst of Kansas City, Kansas - 2. Ella Belle Regan, wife of Richard Ragan of Oklahoma City, Okla. 3. Robert L. Blacker 4. Emilie Albertine Ary, wife of Jas. Ary 5. William D. Blacker Fifth I give and bequeath to my wife Eliza H. Rankin my home farm on which I now reside to hold and enjoy the same with all Rents issue and profits as long as she remains my widow. Sixth After the death of my wife Eliza H. or after she ceases to be my widow, by remarriage, then it is my will, that my Executor shall sell said farm and any other real estate I may have left - at public or private sale, whichever shall bring the most money and divide the proceeds among my heirs above named or their descendants of heirs - after first providing for a dower for my widow if living as the law directs. Seventh- It is my will that my personal property, money, notes, choses in actions and any chattels property I may die seized of or the money arising from the sale thereof be divided after allowing my widow her one third, among my five grand children above mentioned, after deducting such advances as I have heretofore made to some of them which several sums are as follows; 1. Annie E. Ashurst has received one thousand Dollars. 2. Ella Belle Ragan has received Two hundred Dollars. 3. Robert L. Blacker has received Four hundred Dollars, which amounts shall be deducted from their respective shares, but no charges for interest shall be made. Eighth Should anyone of my heirs bring legal action to set aside this will, then such heir shall be and I hereby do disinherit the same and his or her share shall go to the other heirs. Ninth I hereby mane constitute and appoint John N. Parsons Executor of this my last will and testament and in case of his absence or disability to act, then I appoint Jacob Coons of Atlanta as such Executor and I hereby revoke any and all former wills by me made. Rankin, in the Matter of the last Will and Testament of Sinnet Rankin, deceased, for Probate of Will and Letters Testamentary. To the Hon. Charles J. Gehlbach, Judge of the County Court of Logan County, in the State of Illinois: The Petition of the Undersigned Eliza H. Rankin, Respectfully represents that Sinnet Rankin who was at the time of his death a resident of the County of Logan, State of Illinois, departed this life at his home, in Logan County, State of Illinois, on or about the 27th day of September A. D. 1913, leaving a last Will and Testament, duly signed, published and attested, a believed by our petitioner, and which by her, is herewith presented to your Honor for Probate. That said will is subscribed by E. F. L. Rautenberg and S. M. Guttery, as witnesses to the execution thereof. Said S. M. Guttery is now dead. The said Testator in his said last Will nominated and appointed John H. Parsons Executor but he is a resident of State of Kansas, also Jacob Coons, who refuses to serve as such Executor, and his refusal in writing is filed herewith. And this petition further shows that the said Sinnet Rankin died seized and possessed of Real Estate, valued at about Thirty Two Thousand Dollars, and of Personal Property estimated to be worth about Twenty Seven Hundred (2700) Dollars. That said deceased left surviving him, Eliza H. Rankin, your petitioner, residing at his widow, and the following named persons as his only hiers at law and legatees; and their respective places of residence so far as known are as follows: Eliza H. I, Jacob Coons, of Atlanta, Illinois, who was named as the Executor in the last will and testament of Sinnett Rankin, late of Logan County, in the State of Illinois, deceased, do hereby relinquish and renounce all right, claim and title that I may have to act as the Executor of said estate, and herewith refuse to act as such executor of said estate. In the County Court of said County, in Probate Oct Term, A. D. 1913 Personally appeared in open Court E. F. L. Rantenberg subscribing witness to the foregoing instrument of writing, purporting to be the Last Will and testament of Sinnet Rankin late of Logan County, deceased, who, being duly sworn according to law, does depose and say, each for himself, that the foregoing is the Last Will and Testament of the said Sinnet Rankin deceased; that he subscribed his name thereto as the attesting witness at the request of the said Testator, and in his presence, and in the presence of each other, on the 16th day of August A. D. 1889 and to a codicil to said will on Sept 25 - 1901. Quisenberry, do solemnly swear that the within writing contains the true last will and testament of the within named Sinnet Rankin, deceased, so far as I know or believe, and that I will well and truly perform the duties of Administrator with the will annexed of the estate of said deceased, by paying first the debts and then the legacies mentioned therein, so far as the goods and chattels of said deceased will thereunto extend, and the law charge me; and that I will make a true and perfect inventory of all such goods and chattels, rights and credits as may come to my hands or knowledge, belonging to the estate of said deceased, and render a fair and just account of my acts and dealings as such administrator with the will annexed; when thereunto required by law, to the best of my knowledge and abilities, so help me God. The People of the State of Illinois, to all to whom these presents shall come - Greeting: Know ye, that whereas, Sinnet Rankin lete of the County of Logan and State of Illinois, died, on or about the 27th day of September A. D. 1913, as it is said, after having duly made and published his last will and testament, a copy whereof is hereunto annexed, leaving at the time of his death, property in this state, which may be lost, destroyed or diminished in value, if speedy care be not taken of the same; and inasmuch as it appears that John N. Parsons and Jacob Coons have been appointed executors in and by the last will and testament to execute the same: who have refused to qualify as such Executors; now, to the end that the said property may be preserved for those who shall appear to have a legal right or interest therein, and that the said will may be executed according to the request of said testator; we do hereby authorize R. F. Quisanberry as administrator and the will annexed, to collect and secure all and singular the goods and chattels, rights and credits, which were of the said Sinnet Rankin at the time of his decease, in whoever hands of possession the same may be found in this State; and will and truly to perform and fulfill all such duties as may be enjoined upon by the dais will, so far as there shall be property, and the law charge him ; and in general to do and perform all other acts which now are or hereafter may be required of him by law. Estate of Sinnet Rankin Deceased State of Illinois Logan County ss. In County Court, October term 1913 KNOW ALL MEN BY THESE PRESENTS, that we, R. F. Quisenberry as principal, Labau Hoblit & C. H. Turner as sureties of the County of Logan and State of Illinois, are held and firmly bound unto the People of the State of Illinois, in the penal sum of Six thousand Dollars, current money of the United States, which payment, will and truly to be made and performed, we and each of us bind ourselves, our heirs, executors' and administrators, jointly, severally, and firmly by these presents. Witness our hands and seal this 27th day of October A. D. 1913 The Condition of the above Obligation is Such, that if the above bounden R. F. Quisenberry Administrator with the Will annexed, of the estate of Sinnet Rankin deceased, do make or cause to be made a true and perfect Inventory of all and singular the goods and chattels, rights and credits, lands, tenements, and hereditaments, and the rents and profits issuing out of the same, of the said deceased, which have and shall come to the hands, possession, of knowledge of him the said R. F. Quisenberry as such Administrator with the Will annexed, or into the possession of any other person for him and the same so made do exhibit in the County Court for said County of Logan as required by law; and also make and render a fair and just account of his actings and doings as such Administrator to said Court, when thereunto lawfully required; do well and truly fulfill the duties enjoined on him in and by said will, and shall moreover pay and deliver to the persons entitled thereto all the legacies and bequests contained in said will, and not herefore paid or delivered, so far as the Estate of the said testator will thereunto extend, according to the value thereof, and as the law shall charge him and shall, in general, do all other acts which may from time to time be required of him by law, then this obligation to be void, otherwise to remain in full force and virtue. This is to authorize you, jointly, to appraise the goods, chattels and personal estate of Sinnett Rankin late of the County of Logan and State of Illinois, deceased, so far as the same shall come to your sight and knowledge, each of you having first taken the oath hereto annexed; a certificate whereof you are to return, annexed to an Appraisement Bill of said goods, chattels and personal estate, by you appraised, in dollars and cents; and in the said bill of Appraisement you are to set down in a column or columns, opposite to each article appraised, the value thereof. Real Estate The West half of the west half of Section Twenty Seven (27) in Township Twenty One (21) North, and Range One (1) West of the Third (3rd) Principal Meridian, in Logan County in the State of Illinois. Lot Eight (8) in Druley's addition to the original Town now City of Atlanta, in Logan County in the State of Illinois, and also Thirty (30) Feet of uniform width off of the full East side of Lot Seven (7) in said Druley's Addition to said town, being all of said Lot Seven (7) lying between South Race Street and said Lot Eight (8). Quisenberry, the Administrator in said estate and files hwerwith his final receipts showing distribution of the balance remaining in said estate after the payment of all legacies, bequests and all debts and expenses and costs attendant upon the complete settlement of said estate, and asks that the court make his discharge final and complete, and release him from further liability as administrator of said estate.
