Second, after having disposed of a Sufficient amount to pay and discharge the expences and debts aforesaid and that after my death, I give unto my daughter Mernurva Emeline Clandening, the sum of five dollars and then all the property and all real estate or so much there of as may remain unexpended to my two sons James W. and Joseph P Holmes, and their heirs and assigns forever it containing all of my personal property, to wit, beds,and bedding, cattle and sheep, corn and wheat and the West 1/2 of South East 1/4 of the South East quarter of section 17 T. also 10 acres of North West corner of North East 1/4 of North East quarter of section 20 Township No.14 S.R. 4 East containing 30 acres be the same more or less all other things belonging to me not annunerated to be divided equal between the two Boys and lastly I hereby constitute and appoint my said Friend, W.F. Teague, Executor of this my last will and testament revoking and annulling all former wills by me made and ratifying and conferming this and no other to be my last will and testament, in witness whereof I the said Betsy Ann Holmes have hereunto set my hand and seal this 23rd day of October in the year of our Lord one thousand eight hundred and sixty five Betsy Ann Holmes X her mark Signed Sealed Published and declared by the said Betsy Ann Holmes as and for her last will and testament in presence of us who in her presence and in the presence of each other and at her request have subscribed our names as witnesses Charles Staton (seal) Gerhard Binder (seal State of Illinois Massac County In the County Court of said County In probate Nov. term A.D. 1865 personally appeared in open Court, Charles Staton and Gerhard Binder Subscribing witnesses to the foregoing Instrument of writing purporting to be the last will and testament of Betsy Ann Holmes, late of Massac County, deceased who being duly sworn according to law does depose say each for himself that the foregoing is the last will and testament of the said Betsy Ann Holmes deceased that they subscribed their names thereto as the attesting witnesses at the request of the said testator and in her presence and in the presence of each other on the 23rd day of October A.D.1865 that she then and there subscribed her name thereto in their presence and declared the same to be her last will and testament and that the said testator at the time of executing the same as aforesaid was of full age of sound mind and memory and under no constraint Charles Staton Gerhard Binder Subscribed and Sworn to in open Court this 20th day of November A.D. 1865 L.P.
