COUNTY COURT IN THE MATTER OF the Estate of Philip Ausmus TO THE COUNTY: COURT OF SAID COUNTY: The Petition of Benjamin Ausmus respectfully showeth that Philip Ausmus departed this life at his home in this County on, or about the 30th day of December 1856, intestate, That said deceased died possessed of certain Personal Property in the State of Illinois, the value whereof does not exceed the sum of about twenty five hundred Dollars, as your Petiontiner has been informed and believes; that said deceased has left him surviving his eleven children and heirs at law, to wit: Margaret, wife of Madison Clayton ) and widow ) Philip Ausmus, ) Mary, wife, of John B. Liles ) John Ausmus, ) Sarah, wife of James Solomon ) & Andrew J. Ausmus,) Matilda, wife of William Stanley ) who are minors, all under Rachel, wife of Richard Stanley ) eighteen years of age except Philip Henry Ausmus ) who is twenty years of age. Martha Jane Ausmus ) (the decedent left no widow and his Your petitioner Benjamin Ausmus, ) minor children & the said Martha Jane all of whom are now of age. ) lived with him) Who are the only next of kin; that said deceased was a housekeeper and an inhabitant of the County of Morgan, by means whereof, as your Petitioner has been informed and believes the Ordering and Granting Administration of all and singular, the Goods, Chattels and Credits, whereof said deceased died possessed in said State; and also the Auditing, allowing and final discharging the accounts' thereof, doth belong unto the County Court of said County. Your petitioner therefore prays, that you will grant letters of Administration upon the Estate of the said decedent to your Petitioner & William Moss. (under eighteen years of age), being in all three persons, and we do hereby certify, that we have set off to them the above described property at the appraisement thereto annexed. X Ausmus mark Estate of Philip Ausmus Claim of John & Philip Ausmus, Jr. Filed 1 February 1858 Entered Mat Stacy, Clk Transcribed by Edna McPherson John Ausmus claims $40. a/c advanced to purchase 2 calves 1 Bay mare claimed by John Ausmus sold for $90.00 John states that the above property was acquired by him while living with his father & was understood to be his own, but was sold at the sale and proceeds gone into the general estate --under age lives at home. Philip Ausmus Jr. claims 1 Horse sold at $153.00 at sale---claims that he had the privilege to work from home that he traded for a yoke of steers took them home, left them, traded them for 1 Bay horse above set forth which was at his fathers when he died. Property appraised & sold as belonging to estate He claims also $311. entered in the note deposited with Ayers Campbell & Co. on Post & Brothers in Springfield. He states that the father furnished ground to himself & two other Brothers to sow what with the understanding that the wheat was to be sown & taken to market & the cash divided between them all equally. The wheat was sold. He claims that his interest in the proceeds of sale amounts to $311.00 which is in paid notes inventoried to the estate. He also claims 30 acres of wheat sold at sale under the following circumstances, his father rented to him & his brothers 90 acres of ground. They were to pay him the third or 30 acres which they did (?) was sold, 30 acres was set off to him as his part. This was sold at the sale for $82.50 which he claims (?) paid (?). He was underage at the time. The claim for $311.00 interest in the note of Post & Brothers allowed & the $82.50 allowed- the other claim not allowed. John claim not allowed.
