Kehoe, top laborer, aged 22, unmarried, was killed while attempting to place a piece of gas pipe across the top of the shaft to rest the water box on. The evidence shows that the engineer, Mr. Ziegler, was hoisting water out of the shaft by a box fastened under the cage and deceased was attending to the box as it came up, putting a piece of gas pipe across the shaft to rest the box on while it was being emptied and while pushing the pipe under the box the hoisting rope broke carrying deceased down the shaft a distance of 45 feet, killing him instantly.
