J. Edwards of the Township of Loami in the County of Sangamon in the State of Illinois, being of sound and disposing mind and memory, do hereby make publish and declare this my last will and testament in manner following: This is to say: First: I direct and order my executor hereinafter named, as soon after my decease as practicable, to take possession of my personal estate and to convert the same into money, either at public or private sale as he shall deem best, with as little delay as possible, and with the money so to be real- ized, to pay off and discharge all the debts, dues, and liabilities that may exist against me at the time of my decease. Second: I give bequeath and devise to my Son Oscar F. Edwards, the following described Real Estate to – wit: The North East Quarter of the North East Quarter of Section twenty nine (29) in Township fourteen (14) Range seven (7) West of the third principal Meridian situated in the County of Sangamon in the State of Illinois. Third: I give bequeath and devise to my son Staley Edwards the following described Real Estate to - wit: All my interest in any and all Real Estate in the City of Waverly in the County of Morgan and State of Illinois and especially and particularly, all my interest in Lot Number one hundred and thirty nine (139) in Salters addition (first)to the town (now city) of Waverly aforesaid, to have and to hold and to enjoy all and singular the rents and profits during his natural life, and at his death to go to the heirs of his body, but should he die without issue then it is my will that the said Real Estate shall go to my heirs heretofore and hereinafter named in equal parts share and share alike. Fourth: I give bequeath and devise to my son Charles Edwards the following described Real Estate to wit: The South West Quarter of the South East Quarter of Section Twenty (20) Township fourteen (14) Range seven (7) West of the principal Meridian, containing forty acres more or less situated in the County of Sangamon aforesaid. Fifth: I give bequeath and devise to my Son Ollie Edwards the sum of seven hundred (700) dollars. Sixth – I give bequeath and devise to my daughter 556 Harriet Mitchell ( Edwards) the following Real Estate. to wit: The North East Quarter of the South East Quarter of Section twenty (20) in township fourteen (14) Range seven (7) West of the third principal Meridian situated in the County of Sangamon in the State of Illinois, containing forty acres more or less. Seventh – I give bequeath and devise to my daughter Mary Drury (Edwards) the sum of one hundred (100) dollars, also all my right title and interest in and to the undivided one third of the twenty two acres more or less of timber land lying in and adjacent to the village of Loami, which I hold by right of my first wife Virginia Edwards (Jarrett). Eighth: I give bequeath and devise to my daughter Sarah Price (Edwards) the sum one hundred dollars, also the undivided one third of which is hereinbefore devised to my daughter Mary Drury. Ninth: I give bequeath and devise to my daughter Sibyl Greer (Edwards) the sum of one hundred dollars, also the undivided one third of the twenty two acres more or less of timber land the other two thirds of which is herein devised to my daughters Mary Drury and Sarah Price. Tenth: I give bequeath and devise to my daughter Eunice Hiler (Edwards) the sum of two hundred (200) dollars. Eleventh: I bequeath devise and direct that all the rest and residue of my Estate both personal and real be equally divided among my heirs heretofore mentioned. Lastly: I hereby nominate, constitute and appoint my son Oscar F. Edwards the executor of this my last will and testament, hereby revoking all former wills by me made. (x) Edwards (Seal) mark The above instrument was at this date thereof signed, sealed, published and declared by the said J J Edwards as and for his last will and testament, in presence of us, who at his request, and in his presence, and in the presence of each other have subscribed our names as witnesses thereto. Wm Mitchell, residing at Springfield J. L. Wilcox Residing at Springfield Proof of will made and admitted to Probate – Feby 9, 1888 Jas H. Matheny - Judge 557 State of Illinois } SS Sangamon County} In the County Court of said County. The People of the State of Illinois, To County Clerk, Saguache County Saguache Colorado. Whereas, a writing purporting to be the last will and testa- ment of J. J. Edwards deceased, has been produced in said Court for Probate of the same, upon which will the name of Wm Mitchell appears as subscribing witness thereto, which said Will is hereunto annexed, and it being represented to said Court that the said subscribing witness resides at Sagauche in the County of Sagauche and State of Colorado and without the limits of said Sangamon County and that said witness is unable to attend said Court. Now, therefore, we do hereby, in pursuance of the Statute in such case made and provided, authorize you, the said County Clerk, Sagauche , Colorado to cause the said subscribing witness to come before you and to take and certify into our said County Court the attestation of said witness in due form of law. Witness James H. Matheny County Judge of said Sangamon County, and the seal of the County Court of said Sangamon County at Springfield in Sangamon County aforesaid, this 27th day of December A.D. 1887. Jas H. Jones, CountyClerk in and for said County the person to whom the annexed commission is directed, do hereby certify that on the 7th day of January A.D. 1888 William Mitchell, appeared before me in person, who being by me duly sworn does depose and say himself that on the 11th day of March A.D. 1887, J. J. Edwards, signed and published the writing annexed hereto, and to said commission; as and for his last will and testament, in my presence; that the said J. J. Edwards was of sound mind and memory at the time of so executing said will. That he subscribed his name thereto as attesting witness at the request and in the presence of the said testator and in the presence of each other, and that the said testator was of full age and under no constraint. Jones, County Clerk 558 State of Illinois } Sangamon County}SS J. L. Wilcox of the County of Sangamon and State of Illinois being duly sworn on his oath says that he was acquainted with J. J. Edwards the testator in the last Will and Testament hereunto annexed, and who is now dec- eased, that he was present and saw the testator sign said Will, in his presence, and that he acknowledged the same to be his last Will and Testament, and that he believed the said testator to be of sound mind and memory at the time of signing said Will, and that he attested said Will in his presence and at his request. Subscribed and sworn to J. L. Wilcox before me this 15th day of December A.D. 1887. Edwards deceased, so far as I know or believe; and that I will well and truly execute the same by paying first the debts, and then the legacies mentioned therein as far as his goods and chattels will thereunto extend, and the law charge me and that I will make a true and perfect inv- entory of all such goods and chattels, rights and credits, as may come to my hands or Knowledge, belonging to the estate of the said deceased, and render a fair and just account of my administratorship with will annexed, when thereunto required by law, to the best of my Knowledge and ability.
