David Badgley A True Copy In the name of God, Amen, I David Badgley of St. Clair County, in the state of Illinois; considering the uncertainty of this mortal life, and being of sound mind and memory, Blessed be Almighty God for the same, do make this my last Will and Testament, in manner and form following (that is to say) First I give and bequeath unto my beloved wife Rhoda Badgley all monies that may be at my decease, together with all Bonds, Bills, and Notes that is or may be due at my decease, and for her the said Rhoda Badgley to have power of disposing of in any manner which she, the said Rhoda Badgley, may think or see proper hereafter. I also give and bequeath unto my said beloved wife, all the live stock, household furniture, My Beds and Bedsteads, Clock, ______________ and _____________ moveable ______________________________________________________________________ save _______, my own wearing apparel, and after the decease of the said Rhoda Badgley whatever property may be then remaining _____________ Bills, Bonds and Notes, as above bequeathed unto her. I give and bequeath unto my four daughters Viz. Rachel, Mary, Elizabeth, and Priscilla, and the same to be equally apportioned or divided between them and in case of the decease of any or either of my aforesaid daughters, that ___________ bequeathed unto her or them, to go for the use and benefit of her or any of their heirs or assigns. The Bills, Bonds, and Notes reserved in this last bequest will arrear hereafter I wish how to have them dispose of them. I give and bequeath unto my oldest son Aaron Badgley all Bonds, Bills and Notes from him unto me, and all to be null and void by his the said Aaron Badgley's paying David Starr fifty dollars, being the amt of his the said Aaron Badgley's note payable to the said David Starr and also the sum of Fifty dollars to the daughters of my deceased son David Badgley, namely Priscilla and Sally which he the said Aaron Badgley is to pay when the sd Priscilla & Sally Badgley become of age. I also give and bequeath unto my second son Ichabod Badgley all bonds, bills, and notes from him unto me, and also to be null and void, by his the said Ichabod Badgley's paying the aforesd Davd Starr the sum of Fifty dollars when he the sd Davd Starr becomes of age. I further give and bequeath unto the sd Ichabod Badgley, his heirs and assigns, my messuage or tenement (as per article of agreement between him and me) with all the appurtenances thereunto belonging, to hold to him the said Ichabod Badgley his heirs and assigns for ever, by his the said Ichabod Badgley fulfilling his obligations (as per article of agreement) towards me and my beloved wife. ________ will, _________ my ___________ _______________ beloved wife who is sole executrix of this my last will and testament, and Abraham Badgley administrator of the same, to act conformably to these my intentions, by granting him the said Ichabod Badgley a deed of the aforesd messuage or tenement. I further give and bequeath to my younger sons, Job and Abraham Badgley, all Bonds, Bills, and Notes from them unto me, and the same to be null and void after my decease, and all Debts and contracts executed by me to them to be in full force and to them the said Job Badgley and Abraham Badgley their heirs and assigns for ever. I also give and bequeath to my aforesaid sons (namely) Aaron, Ichabod, Job, and Abraham Badgley, all the rest and residue of my moveable property, that is to say A Cart, Mill Stones, Seiners tools, Smiths tools, Turners tolls, etc. and the same to be equally divided between them. I also give and bequeath to the sons of my deceased son David Badgley, namely, Absolom and Abraham Badgley, one quarter section (or one hundred & sixty acres) of land situated on Shoal Creek, adjoining Power's mile, and the same to remain with them, their heirs and assigns forever. I hereby appoint my dearly beloved wife Rhoda Badgley sole executrix of this my land will and testament, hereby revoking all former Wills by me made. In witness ___________, I hereby _____________ set my hand and seal the day of in the year of our Lord One Thousand Eight Hundred Twentytwo. Signed, sealed, published and declared by the above named David Badgley to be his last will and /s/ David Badgley testament in the presences of us, who have hereafter subscribed our names as witnesses, in the presences of the Testator. /s/ Jeremiah Carpenter /s/ Levi Wilderman /s/ John Haskins I David Badgley of the County of St. Clair and the State of Illinois do this tenth day of December make and publish this codicil to my last will and testament in manner following (that is to say) whereas in and by my last will and testament I have given and bequeathed to my two granddaughters (_______) prisylla and Sally Badgley, my son David Badlgey's daughters the sum of twenty five dollars each, I do hereby order and declare that my will is that Neither of the two granddaughters above Named be heirs to my estate in any wise and lastly it is my desire that this my present codicil be annexed to and made a part of my last will and testament to all intents and purposes.
