WILL OF EDMUND FLEETWOOD JR., 1829, St Clair County, Illinois Contributed for use in the USGenWeb Archives Copyright 1999 Joyce Lawrence Transcribed from a microfilm copy of Will Book A, Will #92, pp. 110-111, from St. Clair County Courthouse, Belleville IL by Joyce Lawrence, 9627 Cheddar Street, Downey CA 90242 (rjlawrence@earthlink.net) August 24, 1829 In the name of God Amen I, Edmund Fleetwood, being of sound mind and memory and knowing it is appointed for all persons to die, I make and publish this my Last Will And Testament In manner following, that is to say--- First: I comit my body to the grave to buryed in a Christan like manner and my sowl to the kear of Almighty God-- Second: I give and bequeath to my beloved wife Penelope the land and plantation whereon I now reside consisting of seven arpens laying in the Prarey Depoint Common Fields being Clame No. 1586 and Survey No. 133 and Clame [illegible, looks like 19] and Survey No. 134 and one arpen oute of Clame No. 1585 and Survey 135. Also I give and bequeath to my beloved wife Penelope all my personal estate consisting of horses, cattle, hogs, hous and kitchen furnature together with my crops and plantation utentsils together with debts due me after first paying all my just debts. I hereby nominate and appoint my beloved wife Penelope Executrix to this my Last Will and Testament. [signed] EDMUND FLEETWOOD Witness Jno. Johnston, Jas L. Brackett, William Carr State of Illinois } St. Clair County } The foregoing will being presented for probate, John Johnson, James L. Brackett and William Carr witness to the same, appear and make oath, that the said John Johnston, that he saw Edmond Fleetwood the subscriber to the said will, sign, seal and heard him publish the same as his last will and testament, and that the said testator was to the best of his knowledge in sound health and perfect mind and memory. the said James L. Brackett declares that he signed his name as a witness to the same, sometime after the writing thereof, at the request of the said testator who appeared to him in sound health and memory and that the said testator declared and acknowledged that he signed and sealed the same as his last will and testament. The said William Carr declares that he also signed his name thereto as a witness, at the request of the said testator, who acknowledged to him that he signed and sealed the same and declared it to be his last will and testament, and that at the time, the said testator was in good health and of perfect mind and memory, and that the aforesaid witness's names were signed thereto before he signed the same. Brackett, William Carr Sworn to and subscribed before me this 23 day of November 1829 John Hay, Judge of Probate I do solemnly swear that this writing contains the true last will and testament of the within named Edmund Fleetwood, deceased, so far as I know or believe, and that I will truly execute the same, defraying first the debts and then the legacies mentioned therein, as far as his goods and chattels will thereunto extend and the law charges me, and that I will make a true and perfect inventory of all such goods & chattels, rights and credits as may come to my hand or knowledge, belonging to the Estate of the said deceased and render a fair and just account of my executorship when thereunto required by law, to the best of my knowledge and ability, so help me God. mark of X Penelope Fleetwood Sworn to & subscribed before me this 23 November, 1829 John Hay, Judge of Probate.
