St. Clair County, Illinois, 1864 Will of Henry Mace © Submitted by: McCullough, John I, Henry Mace of the County of St. Clair and State of Illinois being weak of body but sound of mind and memory do make and ordain and establish this to be my last will and testament, hereby revoking all others; and I do hereby appoint John Mace my son, and Anderson Umbarger my son-in-law, to be the executors of this my last will and testament. For the purpose of dividing certain real estate situated in Section nineteen and section thirty in township two north of range seven west, in said county and state, I caused the same to be surveyed by Henry Holbrook, county surveyor of said county, who has made a plat of the same which plat I cause to be attached to this will and made a part of the same. I give and bequeath to my daughter, Elizabeth Tolly's heirs according to the laws of descent the sum of one thousand dollars, to be paid to them by my said executors, out of my person real estate not here-in- disposed of, at my death. I give and bequeath to my daughter Susan Hilt in fee simple, lots numbers one and five on said plat made by said Holbrook as aforesaid. I give and bequeath to the heirs of my son James A. Mace according to the laws of descent in this State, in fee simple lot number nine on said plat. To my son John Mace, in fee simple I give and bequeath lots number two and twelve on said plat. To my daughter Catherine Stites I give and bequeath, in fee simple lots number six and seven on said plat. To my daughter Sarah Umbarger I give and bequeath, in fee simple lot number eight on said plat. To my daughter Lucy Hart I give and bequeath in fee simple lots number three and ten on said plat To my daughter Christine Needles I give and bequeath in fee simple lots number four and eleven on said plat. And it is my will further that if any of my aforesaid devisees die before I do, that the property herein bequeathed to such deceased person shall go to his or her heirs ascending to the laws of descent of this State. And that the residue and remainder of my real and personal property not herein disposed of pass to my heirs ascending to said laws of decent. In testimony whereof I have hereunto set my hand and affixed my seal in the presence of the witnesses whose names are hereto signed by them in my presence and at my request this day of 11 May the Year of Our Lord One thousand eight hundred and sixty four. Signed Henry Mace (his mark and seal) Witnesses (Not clear on copy) Codicil Whereas, I Henry Mace of O'Fallon , St. Clair County, State of Illinois have made my last will and testament in writing bearing date the eleventh day of May in the year of our Lord one thousand eight hundred and sixty four and in an d by which I have disposed of all of my property real and personal except one tract of Land containing one hundred and sixty acres of Land in Madison County, State of Ills. Now therefore I do by this in my writing which I hereby declare to be a codicil to my said last will and testament and to be taken as a part thereof, order and declare that my will is that my Executors John Mace, my son, and Anderson Umbarger, my son in law, shall sell either at public or private sale the following described real estate to wit, the south west qr. Of Section 21 (twenty-one) Town 5 [sic] R 5 [sic] in the County of Madison state of Illinois and after paying the expenses (and after carrying out the provisions of the annexed will) the remainder shall be equally divided between the heirs named in the annexed will and lastly it is my desire that this codicil be annexed to and made a part of my last will and testament as aforesaid to all intent and purposes.
