And this Petition further shows that the said Calvin M Escue died, seized and possessed of Real Estate and Personal Estate, consisting chiefly of horses, cattle, hogs, farming tools, grain and hay together with household goods, all of said personal estate being estimated to be worth about One Thousand Dollars. That said deceased left surviving him Nettie J Escue his widow, and Thomas J Escue, Mary Howel, Edward Escue, Harriet Hines, Eva Cox, Marie Escue, Cleo Escue, Cecil Escue and Ruby Escue, his children, as heirs. That your petitioner (being widow of said deceased)and believing that the said estate should be immediately administered, as well for the proper management of said estate as for the prompt collection of the assets, by virtue of her rights under the Statute she therefore pray that your Honor will grant Letters of Administration to Nettie J Escue upon her taking the oath prescribed by the Statute, and entering into bond in such sum and securities as may be approved by your Honor. signed-- Nettie J Escue State of Illinois, Union county, Nettie J Escue, being duly sworn, deposes and says that the facts averred in the above Petition are true, according to the best of her knowledge, information and belief. Sworn to and subscribed before me, Chas L Kimmel?, Clerk of the County Court of Union County this 22 day of July A D 1922. signed Chas L Kimmel?, clerk of the County Court, by Everett W Dotson, Deputy State of Illinois, Union County In County Court, February, 1926, Term A D 19---- Estate of Calvin M Escue, Deceased To the Hon Ernest s Alden, Judge of the County Court of said county Your Petitioner Thomas J Escue administrator of the estate of Calvin M Escue late of said County, Deceased, respectfully represent: That the said Calvin M Escue departed this life at his home on or about the the 15th day of July 1922, duly appointment by the County Court of said 21st August county of Union aforesaid, as will appear by letters administrator Calvin M Escue estate. (typed over) Bill and Sale bill in said Estate have been duly filed in the office of the Clerk of this Court and that the undersigned his rendered to said Court a just and true account of the personal estate and debts of said deceased, a certified copy of which account is hereto attached and made part of this petition, for reference and evidence, and marked Exhibit --. That Personal Estate of said deceased as appears from the aforesaid account and exhibit amounts one thousand five hundred forty seven & 48/100 Dollars, of which will probably collect or receive the sum of fifty dollars. That the debts and demands allowed against the said estate amounts to nothing, as will more particularly appear from said account, marked "Exhibit --A--" (typed over) be presented and allowed will probably amount to the sum of twelve hundred eighty seven & 3/100. That there has come to the hands of your petitioner Personal Estate to the amount of twenty one & 45/100 Dollars and that he has disbursed the same and paid out opon claims against said estate the sum of eleven hundred ninety-five & 87/100 Dollars, as set forth in Exhibit B. That our petitioner has applied all the proceeds of said personal estate which have come to his possession toward the payment of said debts, as by widow's award and costs and expenses accounts and vouchers on file in this Court will more particularly appear, and that there is a deficiency of personal property to pay the debts of said deceased. And that your petitioner further represent that the said Calvin M Escue died seized in fee of certain Real Estate in said County of Union, State of Illinois, described as follows, to-wit: The northwest quarter of the southeast quarter of section nine (9) and the east one-half of the southwest qr of the northeast qr of said section nine (9) containing 60 acres more or less; and the southeast qr of the northeast qr of said section nine (9), and the southeast corner of the southeast qr of the southeast qr of section four (4), beginning 59 rods north of the southeast corner of said quarter quarter, running south to said corner; thence west thirty two (32) rods; thence northeast to place of beginning, containing 5 & 144/160 acres; all in township eleven (11) south, range one (1) east of the third principal meridian. Also the undivided one-half interest in fee of the northeast quarter of the southeast qr of section nine (9) in said township eleven (11) south, range number one (1) east of the third principal meridian. Subject, however, to the homestead and dower interest of the widow, Nettie J Escue, in said premises, which said dower and homstead interest are unassigned; and that said widow is in possession of said premises. That one M J Drummonds has or claims an interest in said premises by reason of an alleged mortgage of the undivided interest of James Edward Escue, son and heir of said deceased, but that said mortgage lien, if valid, is of no effect or virtue as to this proceeding. That the said deceased left surviving him Nettie J Escue as his widow, having a dower and homestead interest in his real estate, and the following named children, Thomas J Escue, Mary Howell, James Edward Escue, Harriet Hines, Eva Cox, Marie (Escue) Bullock, cleo Escue, Cecil Escue and Ruby Escue, that said Cleo Escue, Cecil Escue and Ruby Escue are minors having no guardian resident in said Union County that no other person or persons have or claim to have interest in or to said premises or any part thereof, other than as above set forth, in possession, remainder, reversion or otherwise. Wherefore, in consideration of the premises, your petitioner pray that this Court may appoint some discreet person as guardian ad litem for said minor heirs to appear for them and defend their interests herein. And your petitioner pray that the writ of summons in sale of Real Estate directed to the Sheriff of Union County, Illinois, for Harriet Hines, Cleo Escue, Cecil Escue and Ruby Escue. To the sheriff of St clair county, said State, for Mary Howell, James Edward Escue, and M J Drummons, and to the Sheriff of Williamson County for Eva Cox and Marie (Escue) Bullock commanding him to summons the said defendants above mentioned, to be and appear before the County Court of Union County and State of Illinois, on the first day of the next February Term thereof, to be held at the Court House in Jonesboro in the County aforesaid, on the first day of February 1926.
