Owen Binder #53 State of Illinois County of wayne On this 8th day of August 1863, personally appeared before me, a county clerk County and State above named, Mary A Owen who after being duly sworn according to law, declares and says that she is aged forty seven years, that she is a resident of near Mt Erie Post Office, County of Wayne, State of Illinois, and that she is the widow of Johnson M Owen who was a private in Company "E" commanded by Captain D ? Ulm of the 40th Regiment of Ills Infantry Volunteers, commanded by Colonel S G Hicks, in the war with the so-called Confederate States, and that she has not in any way been engaged in, or aided or abetted the existing rebellion in the United States, and that her said husband enlisted at Jeffersonville Wayne Co Ills on or about the 25th day of July A.D., 1861 for the term of 3 years and continued in actual service in said war for the term of ____ and was lost at the battle of Shiloh in the state of Tennessee on or about the 6th day of April 1862, and the cause of his death was unknown to applicant but she refers to the evidence herewith transmitted that her husband the aforesaid J. M. Owen lost his life in the battle aforesaid. That she was married to the said Johnson M Owen on the 25th day of January 1835, at in Barren County Kentucky by one David Wright a Minister of the Gospel that her husband, the aforesaid Johnson M Owen died as she believes on the day above mentioned; that her name before her said marriage was Mary A Potter, and that she has remained a widow since the death of her said husband, as will more fully appear by reference to the proof hereunto annexed. And she further states that she believes there is no public record of her said marriage and there is a private record of said marriage in the family Bible of James Owen a resident of Wayne County Illinois whose affidavit is herewith transmitted. She further states that, at his death, her said husband left surviving him only the following named children who were then under the age of sixteen years, that said children reside at with applicant near Mt. Erie Ills and at the date of this declaration were of the age herein stated, viz: Amelia J Owen aged 15 years Alexander Owen aged 13 years Albert Owen aged 11 years & Matilda Owen aged 8 years. She makes this declaration for the purpose of obtaining the Pension to which she is entitled by reason of the services and death of her said husband, under the Act of Congress, approved July 14th, 1862. And she hereby constitutes and appoints James Truscott of Mt Erie Ills her Attorney, to prosecute the claim and procure a certificate. Mary A Owen Sworn and subscribed before me, the day and year first above written, in presence of ??ram Potter W J Sailor J W Barnhill Clk STATE OF Illinois County of Wayne: On the 8th day of August 1863, before me, a co clerk in and for said county, personally came H Potter and James Owen residents of Illinois in the County of Wayne State aforesaid, who, being duly sworn according to law, declare that they are personally acquainted with Mrs. Mary A Owen widow of Johnson M Owen, say that they were present and saw her sign her name, or make her mark, to the foregoing declaration, and were acquainted with her and her said husband before he entered the service, and know that they lived together as man and wife, and were so reputed. That she is the widow of the identical Johnson M Owen who performed the military service mentioned in said declaration, and has remained a widow since his death. That their knowledge of the identity of her husband with the soldier is derived from personal acquaintance and from their acquaintance with her know that she is the identical person she represents herself to be. And they further testify that they reside as above stated, and have no interest in the prosecution of this claim. Joseph h Barrett Commissioner Received, Sept 14, 1863 James Truscott Mt Erie Illinois Attorney State of Illinois Wayne County William Ferrel and WHH Miller being duly sworn according to law deposes and says that they were present at the battle of Shiloh in the state of Tennessee on the 6th day of April 1862 - That they were privates in Co "E" of the 40th Reg Ills Vols - That they were acquainted with Johnson M Owen a private in said Company That they knew him to be sick on the day of the battle above named and had been for some time previous. That they saw him endeavoring to make his way to the River while the enemy were in close pursuit - That they firmly believe the said Owen was overtaken by the enemy and killed as to their best knowledge and belief he has not since been seen or heard from. James Nisbet J P State of Illinois Wayne County B F Best being duly sworn according to law deposes and says that he was present at the Battle of Shiloh in the state of Tennessee on the 6th day of April 1862 - That he was 2nd Lieutenant of Co "E" of the 40th Reg Ills Vols - That he saw Johnson M Owen who was a private in said Company on the day of the battle above named endeavering to make his way from camp to the River - That he knows the said Owen was sick at the time above mentioned and was hardly able to walk - That after the said battle the said Johnson M Owen could not be found and this affiant firmly believes that he was either killed or drowned at the time and place above named. Mount Erie Ill Act 14th July, 1862 Book B Vol. 1 Page 75 STATE OF Illinois Wayne County, On this 3rd day of January 1867 personally appeared before me the undersigned Clerk of the County Court, a Court of Record within and for the County and State above named, and by law duly authorized to administer oaths for general purposes, Mary A Owen who, after being duly sworn according to law, declares that she is aged 51 years; that her Post-Office address is Mount Erie in the County of Wayne and State of Illinois That she is the widow of Johnson M Owen who was a private Co E of the 40th Regiment of Illinois Volunteers in the civil war of 1861-5 for suppression of the Rebellion against the United States Government; and that she has not in any way been engaged in, or aided, or abetted said Rebellion. That by reason of his death in the service aforesaid she is now in receipt of a pension of eight dollars per month under an Act of Congress, entitled "An Act to grant Pensions," approved July 14, 1862,and was last paid upon Pension Certificate No. 28044, bearing date August 13, 1864 to include September 4th 1864, at the Centralia Illinois agency. She makes this declaration in order to obtain the benefit of the provision made by the second section of the Act of Congress, increasing the pensions of widows and orphans, approved July 25th A.D. 1866, for the following named children of hers, the said children being also the children of her said husband at the time of his death, which were under 16 years of age at the date of the passage of said act, and were then and are now living, viz: Albert Owen born in Wayne Co Ills on the 15th day of October 1851 Matilda Jane Owen born in Wayne Co Ills on the 18th day of May 1855 And reference is hereby made to the above named Pension Certificate No 28044 and other papers on file therewith for any necessary evidence not herein contained. That since the death of said soldier she has remained his widow and has not re-married, nor has she abandoned the support of any one of the children above named, nor permitted any one of the same to be adopted by any other person or persons as his, her, or their child. That James Truscott of Mount Erie Illinois is hereby authorized to act as Agent in settlement of this claim, as provided by said Act of Congress, and to receive certificate issued on the same Warrant, Draft or Certificate, as may be allowed. Mary A Owen (her mark) In Presence of C C Boggs Susan E Pharr Sworn and subscribed on the day and year first above written: and on the same day personally appeared James Owen and Susana Owen who, being sworn, declare that they are residents of Wayne County, in the State of Illinois that they are well acquainted with the above applicant; that they have no interest in the above claim for pension; that they saw her make her mark to the above declaration; and they further swear that they have every reason to believe from the appearance of the applicant and their acquaintance with her, that she is the identical person she represents herself to be, and that the said soldier at the time of his death did leave surviving him the above named Mary A Owen his widow and the following named children by the aforesaid widow which were under sixteen years of age at the time of his death, viz: Nancy Owen born on the 13th day of December 1846 Amelia Jefferson Owen born on the 11th day of May 1848 Alexander Owen born on the 15 day of October 1851 Matilda Jane Owen born on the 18 day of May 1855 who are now living; and that the cause of said soldier's death was Battle at Shiloh while in the line of duty in the service of the United States, and that said soldier's widow has not re-married since the death of the said soldier. That they know that the above applicant is the widow of said soldier, and the children hers by the said soldier, and that their knowledge of her identity is derived from personal acquaintance with her for the past 32 years.
