Owen Widow's Claim for Pension The State of Illinois, County of Wayne On this 9 day of August A D 1864 personally appeared before J W Barnhill Clk Co Court, a Court of Record within and for said county, Elizageth M Owen aged 32 years, a resident of Fairfield, in the county of Wayne, and state of Illinois, who, being first duly sworn according to law, doth, on her oath, make the following declaration, in order to obtain the benefit of the provision made by the act of Congress approved July 14, 1862; That she is the widow of Obediah H Owen, who was a private in Company D., commanded by Captain St??ant, in the 40 Regiment of Illinois Vols, commanded by Col Barnhill in the war of 1861. That her said husband died at Chattanooga, in the State of Tenn on the 13 day of June A D 1864 Erysipelas while in the line of duty in the service of the United States. She further declares that she was married to the said Obediah H Owen at Wayne County, on the 9 day of November A D 1848, by one Mr Crews, a Justice of the Peace; that her name before her marriage was Elizabeth M Ellis, and that ever since the death of her said husband, she has remained a widow: as will more fully appear by reference to the proof annexed. That during the existence of the aforesaid marriage there were born to her and her said husband the following named children, who are now under the age of sixteen years, viz: Sarah Frances Owen born the 4 day of November 1849, Laura A Owen born 8th October 1852, Joseph J R Owen born 29 November 1857, Obediah W Owen born 15 September 1860, all of whom are still living, and reside in Wayne County. She also declares that she has in no manner been engaged in, or aided or abetted, the Rebellion in the United States. Elizabeth M Owen (her mark) Also personally appeared C J Scott and J Pulaske, residents of Fairfield in the County of Wayne, and State of Illinois, persons whom I certify to be respectable and entitled to credit, and who, being by me duly sworn, say that they were present and saw Elizabeth M Owen sign her name by making her mark to the foregoing declaration. They further swear that they were acquainted with the said Obadiah H Owen, deceased, in his life-time, and know that he and the said Elizabeth M Owen, lived and cohabited together as man and wife, up to the time when he entered the service, and that they were generally recognized as such by their acquaintances and neighbors, and their marriage was never questioned. That during the continuance of said marriage there were born to them the following named children, all of whom are now under the age of sixteen years, viz: Sarah Frances Owen born 4th November 1849, Laura A Owen born 8th October 1852, Joseph J R Owen born 29 November 1857, Obadiah W Owen born 15 September 1861. That since the death of her said husband, the said Elizabeth M Owen has not married, but is still a widow; and that she is the identical person she represents herself to be. All the foregoing statements they make from their own personal knowledge; and they have no interest in the prosecution of this claim. Act July 25th, 1866 State of Illinois Wayne County On this 6th day of September 1866 personally appeared before me, a clerk of the Ct Court within and for the County and State above named, and by law duly authorized to administer oaths for general purposes, Elizabeth M Owen who, after being duly sworn according to law, declares that she is aged 29 years; that her Post Office address is Fairfield Ills County of Wayne and State of Illinois. That she is the widow of Obadiah H Owen who was a Private Co "D" 40th Regiment of Illinois Vols in the civil war of 1861-65 for suppression of the Rebellion against the United States Government; that she is in receipt of pension certificate 33232 and was last paid to include September 4th 1866, at the Centralia Ills agency. She makes this declaration to obtain the increase pension to which she is entitled under the Act of Congress approved July 25th, AD 1866, for the following named children of hers, the said children being also the children of her said husband at the time of his death, which were under 16 years of age at the date of the passage of said act and were then and are now living, viz: Sarah F Owen born on the 4th day of Nov 1749 Laura A Owen born on the 8th day of Oct 1851 John R Owen born on the 29th day of Nov 1857 Obadiah W Owen born on the 15th day of Sept 1860 That for any necessary evidence not herein contained, see Papers on file in Pension Office, in case of Pension Certif. That they know that the above applicant is the widow of said soldier, and that their knowledge of her identity is derived from personal acquaintance for the past 10 years. That she is the widow of Obadiah H Owen who was a private Co "D" of the 40th Regiment of Illinois Infantry Volunteers in the civil war of 1861-5 for suppression of the Rebellion against the United States Government; and that she has not in any way been engaged in, or aided, or abetted said Rebellion. That by reason of his death in the service aforesaid she is now in receipt of a pension of eight dollars per month under an Act of Congress, entitled, "An Act to Grant Pensions," approved July 14, 1862, and was last paid upon Pension Certificate No. 33232, to include Sept 4th 1866 at the Centralia Ills agency. She makes this declaration in order to obtain the benefit of the provision made by the second section of the Act of Congress, increasing the pensions of widows and orphans, approved July 25th, A. D. 1833, for the following named children of hers, the said children being also the children of her said husband at the time of his death, which were under 16 years of age at the date of the passage of said act, and were then and are now living, viz,: Laura A owen born at Wayne Co on the 8th day of October 1851 John J Owen born at Wayne Co on the 29th day of Novembr 1857 Wilbur O Owen born at Wayne Co on the 15th day of Sept 1861 And reference is hereby made to the above named Pension Certificate No. 33232 and other papers on file therewith for any necessary evidence not herein contained. Oliver Holmes County Clerk DECLARATION OF MINOR CHILDREN FOR PENSION STATE OF Illinois Wayne COUNTY On this 23d day of February A D 1870, personally appeared before Elizabeth M Galiher in and for said County, a resident of Fairfield PO in the County of Wayne and State of Illinois aged 38 years, who, being first duly sworn according to law, doth, on oath, make the following declaration, as Guardian of Minor Children of Obadiah H Owen deceased, in order to obtain the benefits of the provisions made by the Act of Congress, approved July 14th 1862, granting pensions to Minor Children under 16 years of age of deceased officers and soldiers; that she is the Guardian of Joseph J R Owen and Obadiah W Owen whose father was a private in Company D commanded by Captain Hooper in the 40th Regiment of Illinois Volunteers, in the war of 1861, and that the said Obadiah H Owen died in the service at Chattanooga on the 13th day of June in the year 1863 of Erysipelas. That the mother of the Child aforesaid (again married, being now the wife of Henry Galiher) on the 29th day of November in the year 1869 and that the date of the birth of her said wards as follows: Joseph J R Owen born November 29th 1857 and Obadiah W. Owen born September 15th 1860. She further declares that the parents of her said wards were married at Wayne Co Ills on the 9th day of November in the year 1848 by one William Crews a Justice of the Peace. Evidence of said marriage is certified copy of marriage record. She also declares that she has not in any way been engaged in, or aided, or abetted the rebellion in the United States; and she hereby appoints C A Beecher her Attorney irrevocable to prosecute this claim and procure a certificate. They further swear that they knew the said soldier who is represented to have died or was killed, as stated in said declaration, and that he left him surviving no children under sixteen years of age, other than the above named Joseph J R Owen and Obadiah W Owen. That their knowledge of the identity of the soldier as the father of said Minor Children is derived from personal knowledge. They further testify that they have no interest, directly, or indirectly, in this claim.
