Item 1st I give and devise to my son, Jackson, Eighty Acres of Land to wit, the N half of the SW Quarter Sec 34, T6 R10E. Item 2nd I give and devise to my son Garret, Eighty Acres of Land to wit, the S half of SW Quarter Sec 34 T6 R10E. Also one horse, Saddle and Bridle, one Bed and necessary Bedding. Item 3rd I give and devise to my son Edward Eighty Acres of land to wit, the W half SE Quarter Sec 33 Town 6 R10 E. Also one horse, Bridle & Saddle, one Bed and necessary Bedding. Item 4th I give and devise to my son, Wesley Eighty Acres of Land, to wit, the S half of the SE Quarter of Sec 33, Town 6 R10E. Item 5th I give and devise to my daughter, Mary, Forty Acres of Land, to wit, the East Quarter of the North W Quarter Sec 3 T7 R10. Also one horse, Saddle and Bridle and Bed & Bedding. Item 6th I give and devise to my Daughter, Ellen, Forty acres of land, To Wit, W Quarter of NW Quarter Sec 3 T7 R10. Also one horse, Saddle & Bridle & one Bed and Bedding. Item 7th I do hereby nominate & appoint my son, Jackson Executor of this My last Will and Testament, hereby authorizing and empowering him compromise, adjust and discharge in such manner as he may think proper, the debts and claims due me. I do also empower and authorize him, if it shall become necessary in order to pay my debts to sell, by private sale or otherwise as he may think proper, all or any part of my real estate & Execute deeds to purchasers, acknowledge and deliver in fee simple. In testimony whereof I hereunto set my hand and seal this 15th day of April in the year of our Lard 1859. Edward McCallister. Signed and acknowledged by Edward McCallister as his Last Will and Testament in our presence and signed by us in his presence. Test A. B. Gilkin John McCallister State of Illinois White County ss A County Court began and held at the Clerk’s Office in Carmi on Monday, the 15th day of August 1859 for probate purposes. Present: Hon. Wm P. Garrison, Co. Judge R. S. Graham, Clerk At this day comes Jackson McCallister and presents the last will of Edward McCallister dec’d and moves that Probate be made there of which is granted, Whereupon came A. B Gilkin and John McCallister Subscribing witnesses to said Will, who having duly sworn on their oaths say, that they were present and saw said Edward McCallister sign Said will that they then believed and still do believe that he was of Sound Mind and Memory, that they signed said will as witnesses at his request in his presence and in the presence of each other Let it be recorded. Witness R. S. Graham, Clerk of our said Court at Carmi this 15th Day of August A. D. 1859 R. S. Graham, Clerk State of Illinois White County ss I, Jackson McCallister do solemnly Swear, that this writing contains the true last Will and testament of the within named Edward McCallister, deceased, so far as I know or believe and that I will well and truly execute the Same, by paying first the debts and then the legacies mentioned therein as far as his goods and chattels will thereunto execute and the law charge me, and that I will make a true and perfect inventory of all such goods and chattels rights and credits as may come to my hands or knowledge, belonging to the estate of the said deceased and render a fair and just account of my Executor ship when there unto required by law to the best of my knowledge and abilities, So help me God. his Sworn to & subscribed before me Jackson x McCallister Aug 15th 1859 mark R.
