ALLEN -- DEED This Indenture made this 3rd day of August 1839 Between Elijah Smith and Laurenia his wife Lewis Clapp and Rebecca his wife William Tibbetts and Frances Tibbetts his wife Ballard Goben and Malinda Johnson all of Clark County Indiana and George Dickson and Permilla Dickson of the County of Oldham State of Kentucky all heirs of Frances Breeden by their attorney in fact Levi Johnson of said Clark County Indiana of the one part and Joseph N. Allen of the County of Shelby and State of Kentucky of the other part witnesseth that the said parties of the first part by their attorney in fact for and in Consideration of the sum of two hundred and Eighty Dollars to him in hand paid the recept whereof is hereby acknowledged have granted bargained and Sold and by these presence grant bargain and Sell and convey unto the said party of the Second part his heirs and assigns and their undivided Interest in the nine and one third Acres of Land it being a part of that Land purchased by the Late Richard Breeden of Alexander Breckinridge Situate and Being in the County on the waters of Plum Creek the whole tract purchased by Richd of Alexander Breckinridge containing 211 acres 9 1/3 acres of which is hereby Conveyed it being Frances Breedens alias Frances Gobens part of Ballard Breedens interest in said tract which fell to Frances Goben by the death of Frances Breeden To Have and To Hold the Land hereby conveyed unto the said Joseph N. Allen and his heirs forever and the said parties of the first part by their attorney in fact hereby covenant to warrant and defend the title of the said piece of Land unto the said Joseph N. Allen and his heirs against the Claim or claims of all and every person whatsoever. In Testimony whereof the said parties of the first part by their attorney in fact Levi Johnson have hereunto set their hands and seals this day and year first above written. Allen was produced to me in my office on this 15th day of September 1839 and sworn to be the act and deed of the said Levi Johnson by the oath of Joseph W Hornsby a subscribing witness thereto and I further certify that on the 9th day in October 1839 said deed was proven to be the act and deed of the said Levi Johnson by the oath of B. H. Hornsby a subscribing witness thereto Whereupon the said deed together with the foregoing certificate hath been duly admitted to Record to my office given under my hand the date last mentioned James S.
