Dearborn County,Indiana Probate Court November Term 1838 pg 55 In the Matter of the Estate of John Woods Deceased In this matter the Letter of Administration granted by the Clerk in Vacation to Valentine C Woods and William Woods of the Estate of John Woods deceased and the bond taken with Robert Kirkpatrick and Saumuel Fuller their securities in the sum of $1200--are approved by the court. **** Dearborn County,Indian May Term 1842, 3rd Judical Day, page 209 Wednesday morning nine o'clock May 18,1842 Court met pursuant to adjournment, Present the Honorable John Palmer,Judge. William Woods vs. Valentine Woods Margaret Woods Eleanor Woods Petition for Partition of Real Estate Mary Woods,Sen. Mary Woods,Jr. Now come the said petitioner,William Woods by Alexander C.Downey his attorney and proves to the satisfaction of the court that upon the 22nd day of March A.D. 1842 he filed in the clerks office of this court his petition re- presenting to this court that he the said William Woods had a legal right to and as seized in fee simple of the three undivided seventh parts of the following Real Estate situated in the County of Dear- born and described as follows towit; The northwest quarter of Sect- ion number thirty four, in township number 4,range number two west in the district of Cincinnati. And that Valentine C.Woods,Margaret Woods,Eleanor Woods & Mary Woods(Junior)(the last three of whom are minors) of said county are coparceners with the said William Woods in the said premises and that Mary Woods(Siegnor) of said County as widow of John Woods deceased is entitled to dower in the same premises. And praying that partition of said lands might be made and that three seventh parts thereof might be assigned and set apart to the said William Woods in severalty. And that the dower of the said Mary Woods(Seignor)might if she required it be assigned and set off to her in said premises. And the said petit- ioner now proves to the satisfaction of the court by affidavit of a disinterested person duly sworn to and filed in open court that notice of the pendency of this petition aforesaid has been given by a publication thereof in the "Dearborn County Register" & pub- lished of general circulation printed and published in said county for these 4 weeks in succession at least 4 days prior to the first day of the present term of this court as required by law, notify- ing the said Valentine C Woods, Margaret Woods, Eleanor Woods, Mary Woods Jr. and Mary Woods Sen., that he the said William Woods had filed in the clerks office of this court his petition for par- tition of the Real Estate aforesaid and that he the said William Woods, would at this term of this court and upon this day move this court to appoint commissioners to make partition and set off amd assign to said William Woods three seventh parts in severalty of said land. And thereupon on motion the court appoint Theodore Gazlay guardian, ad litem,of the said Margaret Woods,Eleanor Woods, Mary Woods Jr.,for the purpose of defending the rights of said infants in the premises and the said guardian ad litem now appears and accepts said appointment and files his answer stating that he knows nothing of the matters and things in said petition stated, but asks the court to protect the interests of said infants. And the court having seen and inspected the said petition,notice, and answer, and the matters and things therein contained order and direct that Nathaniel S.Squibb,John M.H.Monroe and John Ray three disinterested freeholders of said county residents of said county, not related to either of the aforesaid parties,as comm- issioners to assign and set apart to the said William Woods in severalty the three undivided seventh parts of the Real Estate aforesaid and described and set forth in said petiton and that the said commissioners assign to Mary Woods(Seignor) and set off to her,her dower in the Real Estate aforesaid if she shall require said dower to be assigned and set off to her. And that the said commissioners make report of their proceedings in the premises to and at the next term of this court and day is given. **** 2nd day of August Term 1842 & 9th day of said month,page 246 William Woods vs. Valentine Woods Margaret Woods Petition for Partition Eleanor Woods Mary Woods,Sen. Mary Woods,Jr. Now come Nathaniel S.Squibb,John W.H.Monroe and John Ray, the commissioners who were ap- pointed at the last term of this court to assign and set apart to said William Woods in severalty the three undivided seventh parts of the following described Real Estate siuated in Dearborn County, Indiana towit; the Northwest quarter of Section number 34,Town- ship number four and Range number two west in the District of land sold at Cincinnati* and to set off to the said Mary Woods Sen.her dower in said lands if she requested it. Now come into court and make the following report of their proceedings in the premises towit.(here insert it) which said report is now acknowledged by the said commissioners in open court. It is ordered by the court that said report be approved of and received by the court. It is further considered by the court that the said, William Woods,pay the costs of the proceeding. **** * Note the land described above is the land Joseph Woods,brother of John Woods deceased, filed for on 28 Oct 1816 in the land entries of Indiana, Cincinnati District.
