Last Will & Testament of Robert Turner I,Robert Turner of Ceaser Creek Township,Dearborn County,Indiana, do make and publish this my last Will and Testament hereby revoking and making void all former wills by me at any time hereunto made. First,I direct that my Body be decently interred and that my funeral be conducted in a manner corresponding with my Estate and situation in life,and as such worldly Estate as it has pleased God to entrust me, I dispose of the same in the following manner to wit. I direct that all my just debts and funeral expenses be paid as soon after my decease as possible out of the first moneys that shall come into the hands of my Executor from any portion of my Estate,Real or per- sonal. I also direct that my beds and bedding and bed clothes of every kind be dived between my two daughters,Martha Graham and Sarah Pate, share and share alike and to be aportioned by Susana Cole. I also direct that the whole of my household furniture be divided in like manner between my two daughters above mentioned. I also direct that my Roan Horse I leave to Hannah Crandall, eldest daughter of Daniel Kelsy, for the great friendship she showed to my family in their last illness*, and I also bequeath unto William Turner, my oldest son all my cow cattle that I possess. I also direct that all the rest of my personal Estate be divided between all my children alike, and alike by my Executor. I also direct my Real Estate be sold by my Executor either for ready money or on credit as he can best do so and as soon as it comes into his hands to make a divide betweenst all of my children alike and alike six in number,Namely, Martha,Sarah,William,James W.,Robert and Rebecca. I also bequeath all my wearing apparel to my son James Turner, and I hereby make and ordain my worthy and Esteemed friend, Harvey Cole, Executor of this my last Will and Testament in witness whereof I,Robert Turner the Testator have hereunto set my hand and seal this second day of April in the year of our Lord Eighteen hundred and fifty one. Be it remembered that on the 27th Day of June A.D. 1851,personally came before me the undersigned Clerk of Dearborn Probate Court, Harmon R.Dean one of the subscribing witnesses to the above and foregoing last Will and Testament of Robert Turner, deceased. Who being duly sworn by me,saith that he was present when the said, Robert Turner signed said Will, that he signed his name as a wit- ness thereto in the presence of the Testator, and at his request, and in the presence of Catherine Dean, the other subscribing witness to said Will & that said Robert Turner signed said Will and declared the same to be his last Will and Testament in the presence of this affidavit and the other subscribing witness as aforesaid and that the Testator at the time of signing the same was of full age to devise his property and of sound mind and memory and not under any coersion or restraint whatever. I,Cornelius O'Brien Clerk of Dearborn Probate Court do hereby certify the within and foregoing last Will and Testament of Robert Turner, deceased,was duly proved on this day by the affi- davit of Harmon R.Dean one of the subscribing witnesses to said Will and duly admitted to Probate and Recorded in Record of Wills, No.3,pages 52&53. Cornelius O'Brien Clerk **** * The "families last illness" referred to by Robert Turner in his last Will and Testament was the chlorea that killed his wife, Martha Woods Turner(1785-1849), two of his daughters and his son, Munce Samuel Turner in the summer of 1849.
