Filed May 11th, 1841 , H.H. Fallon Ck. Recorded: Probate County Court of Decatur County Indiana, page 292. May Term, 1842 In the matter of the guardianship of Susan Douthit, Madeline Douthit and Jane Douthit. Be it remembered that heretofor to wit on the eleventh day of May in the year of our Lord one thousand eight hundred and forty one the following Petition was filed here in the Probate County Court of Decatur County Indiana. To Wit: To the honorable Angus C. McCoy, sole judge of the Decatur County Probate Court, the petition of Susan Douthit, Madaline Douthit and Jane Douthit. Humbly sheweth unto your Honor that sometime in the 1839, David Shelton the grandfather of your petitioners, in his last will and testament bequeathed unto them the sum of fifty dollars each, which money or legacy is now in the hands of the administrator of their said grandfather David Shelton, that they are all infants under the age of twenty one years that John Douthit is the natural guardian and father of your petitioners wherefore your petitioners pray that your Honor will appoint their said father John Douthit as their guardian during their minority to hold for their benefit, and loan the sum of interest, the said legacy of fifty dollars, so made to each of your petitioners by their said grandfather David Shelton and yours petitioners... Susan Douthit Madaline Douthit Jane Douthit And afterwards to wit at the May Term of said court on the day and year last aforesaid, the following order was made for the appointment of said guardian to wit. This day came Susan Douthit and Madaline Douthit, aged fourteen years, infant children of John Douthit, and chosed John Douthit, their father to be the guardian of their persons and estates until they arrive at the age of maturity. And on motion it is ordered by the court that the said John Douthit be appointed guardian of the person and estate of Jane Douthit, infant daughter of the same John Douthit and that he enter into bond in the penal sum of three hundred dollars conditioned as required by law, for the faithful performance of his duties as guardian of the persons and estates of the said Susan Douthit, Madaline Douthit, and Jane Douthit until they arrive at the age of maturity, whereupon the said guardian executed his bond with James Treemain his security the court approves. And afterwards Towit at the November term of said court, To wit the twenty second day of November in the (page 293) year of our Lord one thousand eight hundred and forty one. On motion, It is ordered by the court that a citation issued against John Douthit guardian of the persons and estates of Susan Douthit, Madaline Douthit, and Jane Douthit returnable to the first day of the next term of this court requiring him to shew cause if any he can, why he shall not give additional bond for the performance of his duties as such guardian. And afterwards to wit at the February term of said court to wit the eighteenth day of February in the year of our Lord one thousand eight hundred and forty two. It was ordered by the court that an alias citation issue against John Douthit guardian of the persons and estates of the said Susan Douthit, Madaline Douthit, and Jane Douthit returnable to the first day of the next term of this court, requiring him to appear at said term and shew cause (if any he can shew) why he shall not gain additional bond, with security for the faithful discharge of his duties and trusts committed to him as guardian as aforesaid. And afterwards to wit at the May term of said court, to wit the twelfth day of May in the year last aforesaid, the court made the following order and decise To wit. In the matter of the guardianship of Susan Douthit, and Melinda Douthit, and Jane Douthit, John Douthit the guardian of said wards having been duley cited to appear here at the present term of this court and give additional bond for the faithful discharge of the duties and trusts committed to him as such guardian and he having failed to appear and give such additional security, and it appearing to the satisfaction of said court, that the citation in this case has been duely served an said guardian more than ten days prior to the first day of the present term of this court. It is therefore considered by the court that the letters of guardianship be granted by this court to the said John Douthit for the persons and estates of the said Susan Douthit, Madaline Douthit, and Jane Douthit be revoked and set aside.
