Clements for Letters of Administration upon the estate of Valentine Webb deceased, who entered into bond in the penal sum of Six hundred dollars with Richard Swift security, and was thereupon sworn as such Administrator in the words and figures following to wit: State of Indiana} Franklin County} seal Personally appeared before me Robert John Clerk of the Probate Court of the County of Franklin aforesaid John N. Clements Administrator of the Estate of Valentine Webb deceased who being duly Sworn on oath Saith that he will truly & faithfully perform the duties and trusts committed to and required of him as administrator of the Estate of the said Valentine Webb deceased Sworn & Subscribed to before me this 5th day} John N. Clements of June AD 1841 Robert John Clk. P.C.F.C There upon Said John N Clements took upon himself the administration of said Estate and Letters of Administration were granted to him in the words and figures following to wit: State of Indiana} Franklin County} seal I Robert John Clerk of the Probate Court of the County of Franklin in t he State of Indiana do certify that Administration of the goods chattels rights credits monies and effects which mere of Valentine Webb late of the said county deceased who died intestate is granted unto John N. Clements is authorized to administer the same according to law. {Seal} Witness my hand and the seal of said Court the 5th day of June in the year of our Lord one thousand eight hundred and forty one Robert John Clk P.C.F.C In the Matter of the Estate} On Petition to make Of Valentine Webb deceased} real Estate Assets. Comes John N. Clements administrator of the estate of Valentine Webb deceased and files the following inventory and appraisement of the real Estate of the said ( here insert) and thereupon the said Administrator now files the following Suggestion of the insufficiency of the personal estate to pay the debts of said decedent to wit (here insert) Thereupon on motion the Court order that the said Widow and heirs named in said written Suggestion be Summoned to appear at the next term of this Court at the Court house in Brookville before the Judge thereof on the Second day of the term commencing on the Second Monday of May next and Show cause of any they can why the real estate in said Inventory of Appraisement & Suggestion named Shall not be sold and made assets for the discharge of the debts and demands outstanding against said Estate 256 February Term AD 1844 Plea held at Brookville in the County of Franklin and State of Indiana on the twenty seventh day of February in the year of our Lord one thousand eight hundred and Forty four Before Henry Berry Esquire Judge of the Probate Court of said County being the February Term of said Court and among other things of dais term is the following to wit: In the matter of the Estate} On petition & suggestion to Of Valentine Webb deceased} make land assets Be it remembered that heretofore to wit on the 3rd day of March AD 1842 John N Clements Administrator of said estate filed in the Clerks office of Franklin County the following petition to wit State of Indiana} ss Franklin County} To the honorable Henry Berry Judge of t he Probate Court of Franklin County} Your petitioner John N Clements Administrator of all and singular the goods chattels rights & credits which were of Valentine Webb late of said County dec’d would respectfully represent that so far he has ascertained the debts & demands outstanding against said Estate amount $361 besides cost of administration and that the personal assets which have come into his hands to be administered amount to only about $96 after the widow rec’d her $1000 Your petitioner therefore suggests to the Court now here that the personal estate of said decedent is insufficient to pay and satisfy the debts and demands outstanding against the same. Your petitioner would further represent that said decedent died seized & proposed of the real estate described as follows to wit: one lot in the Town of Blooming Grove & County aforesaid and known in the Town by No. forty two with all appurtenances thereunto belonging which your petitioner prays be made assets in his hands. And your petitioner would further represent that the said Valentine Webb left the following Heirs to wit Anna Webb (widow) John Webb Sarah Webb Henry Webb Abraham Webb Luke Webb Jacob Webb Lucy Webb Elizabeth Webb Hannah Webb Volentine Webb Richard Webb Frances Webb Mary Emaline Webb which includes Sons and Daughters of said Valentine Webb deceased the undersigned Administrator therefore prays your Honorable Court to order the sale of the interest which said deceased in his life time had in the said real Estate to pay the debts and demands outstanding against the said Estate of the said deceased and grant him such other relief as the nature of the case may require John N Clements Admin And on said 30 day of March AD 1842 the said administrator filed in the Clerks office aforesaid the following appraisement Bill towit 257 February Term AD 1844 An Inventory of the Estate of Valentine Webb Late of Franklin County Deceased As taken by John N Clements Adm. By the assistance of David Ginn and John Naylor appraisers towit One in lot in the Town of Blooming Grove County aforesaid and known in the Plat of said Town by No. forty two with all the appurtenances thereunto belonging We the undersigned being called upon to appraise The above real Estate on examining the above premises consider it worth Two hundred and fifty dollars (including widows right of dower) March 2 1842 David Ginn Sworn and subscribed to before me John Naylor This 2nd day of March AD 1842 Isaac Clements Justice of the Peace {seal} And afterwards to wit at the May Term of the Court aforesaid on the 10th day of May AD 1842 before the Judge aforesaid And now comes at this day it appearing that the Widow & heirs named in the written suggestion heretofore filed have not yet been summoned ; the Court order that they be summoned to appear at the next Term of this Court at he Court house in Brookville before the Judge thereof in the second day of the Term commencing on the fourth Monday of August next show cause if any they can why the Real Estate in said inventory & Appraisement & suggestion named shall not be sold & made assets for the discharge of the debts and demands outstanding against said Estate and this case is continued. And afterwards to wit At the November Term of the Court aforesaid on the 15th day of November AD 1842 before the Judge aforesaid Now comes John N Clements Administrator and shows to the Satisfaction of the Court from the Sheriffs return to the summons in this case to August Term 1842 that all the said heirs have been summoned excepting John Webb & Abraham Webb two heirs of said Estate who this administrator from information says are not residents of this state who were not found thereupon on motion the Court order that the said John Webb & Abraham Webb be notified to appear at the next Term of this Court at the Court house in Brookville before the Judge thereof on the second day of the Term commencing on the fourth Monday in February next and show cause if any they can why the real Estate in said inventory of appraisement and suggestion named shall not be sold and made assets for the discharge of the debts and demands outstanding against said Estate and this case is continued February Term AD1844 And afterwards to wit at the February Term of the Court aforesaid on the 27th day of February AD 1843 before the Judge aforesaid Comes John N. Clements administrator by John Houland his atty and it appears to the satisfaction of the Court that publication of the pendency of said petition has been given in the Indiana American a weekly newspaper printed and published id said County for three weeks successively but not 60 days before the 1st day of the present Term of this Court whereupon on motion this case is continued And afterwards to wit at the May Term of the Court aforesaid on the 8th day of May AD 1843 before the Judge aforesaid And now comes John N Clements Adm of the said Estate and Houland his attorney and in motion Sarah Webb John Webb Henry Webb and Anna Webb were three times audibly called but wholly make default and it appears to the satisfaction of the Court by the Sheriffs return that service has been made upon the above named Sarah Henry and Anna Webb more than 30 days prior to the first day of the present Term of this court and that as to John Webb one of the heirs in this case publication of the pendency of said petition has ben givin in the Indiana American a weekly Newspaper printed and published in this County of Franklin for three weeks successively sixty days prior to the first day of the present term of this Court and thereupon on motion of said administrator the Court appoint Hiram Carmichael Guardian ad litem for Abraham Webb Luke Webb Jacob Webb Lucy Webb Elizabeth Webb Hannah Webb Volentine Webb Francis Webb Mary Emaline Webb minors children and heirs of said deceased who now comes into open Court enters his appearance for said minors and says he does not know of any reason why the prayer of said petition may not be granted thereupon the said John N Clements now files his additional bond in the sum of $500 with R.P.C. Barwick Security who is approved of by the Court And thereupon the Court order the said John N Clements Adm. As aforesaid to sell the real Estate in the said petition named and make the same assets in the hands of said administrator first giving three weeks notice of such sale by publication in some week by newspaper printed and published insaid County prior to sale and by setting up three advertisements in the Township in which such real Estate is situate and further to proceed to consumate such sale agreeably to law and report his proceedings to the premises to the next term of this Court and this case is continued And afterwards to wit May Term of the Court aforesaid on the 28th day of August AD 1843 before the Judge aforesaid Comes John N Clements Administrator and now files his report of the sale of the real Estate in the said petition mentioned 259 February Term AD 1844 State of Indiana } Franklin Probate Court of the Franklin County } Term of August AD 1843 Franklin County to wit. To the Honorable Henry Berry sole Judge the Franklin Probate Court in and for said County. John N Clements Administrator of the goods and chattels rights credits monies and affects which were of Valentine Webb late of said County deceased respectfully represents that in pursuance with an order at the last term of this Court he proceeded to sell the following real Estate to wit. In lot No. forty two (42) in the Town of Blooming Grove in said County having first given notice of said sale by three notices posted in the most public places in the Township in which said real Estate is situated and advertising the same for three weeks successively prior to the day of sale in the Indiana American a weekly newspaper printed and published in said County. And having first caused the same, to be appraised under oath by James M Clements and James C Allison house holders of the County aforesaid who appraised the same at the sum of $130 and that on the 25th day of June AD 1843 between the hours of 10 oclock AM and 4 oclock PM in the premises aforesaid there being there and there three persons having an opportunity to bid the said real Estate was openly struck off to J. Haywood for the sum of $130 payable on the 25th Dec next the said Haywood being the highest bidder & that being the full appraised value of said real Estate. All of which is respectfully submitted. J N. Clements Houland his Atty. Here follows the appraisement Bill of said real Estate named in the above Sale Sale Bill to wit. The undersigned James C. Allison and James M. Clements having been appointed by John N Clements Administrator of the Estate of Valentine Webb late of the County of Franklin and State of Indiana deceased after having been duly sworn make out the following appraisement of lot No. 42 in the town of Blooming Grove & which property the said deceased died {unknown word} of To wit: One hundred and thirty dollars subject to the widows dower & Givin under our hand ands seals this 19th June 1843 Sworn and subscribed to before me } James M Clements This 19th day of June AD 1843 } James C Allison {Appraisers} Isaac Clements Justice of the peace And acknowledges the same in open court. And it appears to the satisfaction of the Court by affidavit that due notice of said Sale was given according to the law relating to the sale of real Estate upon execution . And that the Court confirm the said sale and order the said administrator on the payment of the consideration money to make and deliver to the purchase a good and sufficient deed 260 February Term AD 1844 For the same and make return of his doings in the premise at the next Term of this Court thereafter. And afterwards to wit at the February Term of the Court aforesaid on the 27th day of February AD 1844 before the Judge aforesaid. Comes the Administrator by Houland his attorney and now files his Report of having made Deed . In the Franklin Probate Court of the February Term AD 1844 Jno N. Clements adm. Of the Estate of Valentine Webb dec. reports that he has received the consideration money of the real Estate aforesaid and has executed a deed to James Haywood pursuant to the order of this Court made at its last term.
