Goldsberry Kind of Deed: Sheriff Filed March 23, 1880 This Indenture made this 22nd day of March AD 1880 between Alexander H. Duke Sheriff of Howard County in the State of Indiana of the first part and Thomas B. Goldsberry of the County of Howard and State of Indiana of the second part. Witnesseth: That Whereas at the October Term of the Howard Circuit Court AD 1878. The Aetna Life Insurance Company of Hartford Conn. Recovered by judgment of said Court in a certain action therein against Christina Fording Et al the sum of Six hundred and fifty ($650) Dollars and Sixty Eight (68) cents for their damages together with the further sum of Sixty Two ($62) Dollars and fifty (50) cents for their cost in that behalf expended; and a decree for the sale of all the interest, estate, right and title of the defendants Christina Fording Et al in and to certain real estate described therein as follows viz: The North West quarter of the Northwest quarter of section Six (6) in township twenty four (24) North of Range three (3) East P.M. 2nd fractional containing forty nine and ninety one hundredths (49 91/100) acres situated in Howard County Indiana. All without any relief whatever from valuation or appraisement laws, as by the record thereof remaining in said Court more fully appears. And Whereas, Afterwards, towit: on, the 11th day of February A.D. 1879,a copy of said judgment and decree was duly issued and under the seal of said Court attested by the Clerk thereof, directed to the Sheriff of the County of Howard commanding him that after due and legal notice of the time and place of making the same he should sell the land above described with all the interest, estate, right and title of the defendants ~ Christina Fording Et al therein or so much and such parcel thereof as might be necessary according to the term of said decree to pay and satisfy the judgment aforesaid with the interest and cost thereon; and that he should in like manner also make and return all interest and accruing costs thereon, and make due return of said writ to the Clerk’s office at the expiration of one hundred and eighty days from the date of the same. And whereas Said copy of judgment and order of sale on the 11th day of February A.D. 1879 came to the hands of Alexander H. Duke then the Sheriff of said county to be executed, and the said Alexander H. Duke as said Sheriff as aforesaid having legally advertised the same did on the 10th day of March A.D. 1879 at the Court House door in Kokomo in the County aforesaid, between the hours prescribed by law, at public auction, first expose to sale the rents and profits for a term not exceeding seven years, of said estate of Christina Fording Et al in and to said Real Estate and no person bidding for the same than offered at public auction aforesaid all the rights title and interest in fee simple, of the said Christina Fording Et al in and to said estate and the said Aetna Life Insurance Company by atty did then and there bid the sum of Seven hundred and thirteen ($713) Dollars and Eighteen (18) cents.
