Your petitioner wants further represent that there has yet no assetts come into his hands to be administered and that there will not be sufficient assetts to satisfy the debt and demands outstanding against it Said petitioner therefore prays that he may be allowed to settle said estate as insolvent in conformity with the Statute in such casesmade and provided that the creditors notified accordingly and that he may have such others and further relief as may be consistent with justice & Equity. And your Petitioner will ever pray &c Elijah DAY State of Indiana, Jackson County, Sct Elijah DAY having duly sworn says that the above petition and the matters and things therein contained are true as he verily believes. Sworn and Subscribed to before} me this 13th day of May 1847 } Elijah DAY} Wm H EWING clk } } It is therefore considered and ordered that the filling and pending of the said comprised be made known to the heirs and creditors of said deceased by publication of six weeks in the Washington Republican a weekly newspaper published at Salem Indiana and that they be informed that unless they notify the said administrator of the existance and extent of their claims with the proper description previous to the final distribution of the assets of the estate of said decedent such claim will be postponed[?] in favor of the claims of the more diligent creditors, And said Court[?] do further declare their opinion that said estate is probably insolvent all of which is fully ordered by the Court and this cause is continued Now at this time to wit the ninth day of August in the year of Our Lord one thousand Eight hundred and forty eight [eight crossed out] seven The said administrator by Daniel H LONG has ---[illeg] come and suggests to the Court that the defendant left as his heirs and children at law Agnes COLLINS intermarried with Charles COLLINS Susan IRELAND intermarried with Daniel IRELAND Thomas JOHNSON Moses JOHNSON Alfred JOHNSON and the widow of said decendent Rebecca JOHNSON and prays they may be made parties to the plantiff's petition. The widow is Elinor [?] p. 527 August 1848--Benjamin CARTER deceased, on 13 August 1842 leter of administration were issued to Nancy CARTER [record continues through p. 534] p. 584 Alexander B. HANNER vs William B DURHAM [William's wife Ruth is an heir of Bartholomew HANNER deceased] "584 Jackson Probate Court Alexander B. HANNER vs William B. DURHAM And Others--------Chancery Record of Proceedings and Files of the Probate Court of Jackson County in the State of Indiana in the above entitled case, determined at the August Term of said Court in the year of our Lord one thousand Eight hun dred and forty Eight before the Hon William WILLIAMS Probate Judge Be it Remembered that on the 28th day of December in the year of our Lord one thousand eight hundred and forty seven Alexander B HANNER by Daniel H LONG his Solicitor filed in the office of the Clerk of said County his certain [sp?] Bill in Chancery in the words and figures which follow To wit To the Hon the Judge of the Probate Court of Jackson County & State of Indiana in chancery sitting at the February Term 1848 Your [?] Orator [?] Alexander B HANNER a resident of your said County wants [??] most [?] respectfully represent that William B. DURHAM in right of his wife Ruth DURHAM on the ____ day of ____ in the year 188_ or so [?] seized [?] in fid [?] simple lz [?] inheritance as heir at law of Bartholomew HANNER deceased who departed this life about the __ day of __ in year 18__ of the one [?] equal undivided tenth part in Value and hold the same as a trust in common with nine other heirs of the said Bartholomew the following described lands situated in said county To wit The East half of the South West quarter of section thirty five Township six Range four containing eighty acres and the said William B. DURHAM and the said Ruth his wife being so thereof seized and possessed did on the __ day of __ in the year 18__ at said County sell to your Orator all of their inherited right and title in and to said land for the sum of thirty dollars being the full value of their dais interest at that time [?] in and to the same. And your Orator paid to the said Willliam B DURHAM & to the said Ruth his wife the full amount of the purchased [?] money at the time [sum?] last aforementioned and took their reciept in writing for the same And the said William B and the said Ruth his wife his [?] and their [?] promised and agreed with your Orator to make and execute to your Orator a ggod and Sufficient deed in fee [?] simple [?] and convey to your Orator all of their interest aforesaid in the lands aforementioned to your Orator and give your" [end of p. 584. I transcribed the following from a subsequent page:] "The said William B DURHAM and the heirs of the said Ruth DURHAM to wit Bartholomew DURHAM Sophia DURHAM & Isaac IRELAND and Elizabeth IRELAND his wife the said Isaac in right of his said wife and Rebecca DURHAM..." I made 6 copies from this film (1314752) Items 2 and 3: It's not clear if I examined all of item 2 and 3. I think I examined all but McKinney CARTER, Omri TUELL, and I'm not interested in them anyway. CRANE admin dc On 08 Apr 1839 John JACOBS was issued letters of administration, on 11th February 1840 Obadiah M CRANE... p. 444 " August Term 1849 444 Estate of John BUNNELL Deceased Complete Record of the files and proceedings of the Probate County of Jackson County in the State of Indiana in the administration of the Estate of John BUNNELL deceased by Aaron STRYKER Administrator, and in the final settlement thereof by him before the Honorable William WILLIAMS Probate Judge of said Court, at the August Term thereof in the year of our Lord one thousand eight hundred and forty nine Be it remembered that heretofore to with on the 20th day of February in the year of our Lord one thousand eight hundred and forty six letters of administration were issued on said estate in the words and figures following to wit and entered upon the records of said court 'State of Indiana Jackson County Sct.[?] I John HAMILTON Clerk of the Probate Court in and for the County of Jackson in the State of Indiana do hereby certify that administration of the goods, chattels, rights, credits, monies, and effects which were of John BUNNELL late of Jackson County deceased who died intestate is granted to Aaron STRYKER, and the said Aaron STRYKER having qualified and given bond as such administrator is duly authorized to take upon himself the administration of such estate according to law. //S.S.// Witness my hand and the seal of said Court the 10th day of February in the year of our Lord one thousand eight hun dred and forty six. On the said 21st day of March in the year of our Lord one thousand eight hundred and forty six said administrator also filed in the ofice of said court the following to wit Sale Bill of the personal property of John BUNNELL late of Jackson County decd made by Aaron STRYKER Administrator in[?] said estate on the 7th day of March 1846 One dozen of buttons one pocket knife to Aaron STRYKER .22 1/2 [?] Two pocket books & purs [?] & two plugs tobacco William IRELAND paid .10 William IRELAND Martingale .25 Daniel IRELAND Riding Bridle .90 1/2 Aaron STRYKER Remmnant of Janes[?] .50 Thomas JOHNSON Man's[?] saddle 4 05 William IRELAND One Mair 24 10 ----- 30 03 Edward CRABB State of Indiana Jackson County ss[?] Personally appeared before the Clerk of the Jackson County Probate Court, the within named Edward CRABB, Clerk of sale[?] who being duly sworn says that the within is a just full and complete account of the sale of the personal property of John BUNNELL decd late of said county sold in the 7th day of March 1846. Sworn to and subscribed in this 25th day of July 1846 Wm H EWING Clk } Edward CRABB by Fred WISE Dpty At the February Term of said Court in the year of our Lord one thousand eight hundred and forty nine said Court ordered a writ of Citation against said Admr to appear before said court and show cause why final settlement of said estate should not be made. Whereupon a Citation was issued returnable at the May Term of said Court A.D. 1849 and executed by the Sherrif of said County. At the May Term of said Court A.D. 1849 said Administrator appeared and on his motion ordered a continuance of the cause Now at this time to wit August twenty second and at the August Term of said court in the year of our Lord one Thousand eight hundred and forty nine comes the said administrator and files his Account Current in the words and figures following to wit The Account of Aaron STRYKER Administrator of all and singular the goods and chattels rights and credits which were to John BUNNELL late of Jackson County deceased March 1846 Dr.[?] The admr charges himself with the amount of the Sale Bill of the personal property of deceased as per Sale Bill" [end p. 446] [p. 447:] "447 Probate Court of Jackson Co on file in the Clerks office 30.03 To amount of money on hand .10 To 4 Notes of hand on Mordica STOOKEY [?] $100.00 ------- 130.30 [sic] 1846 Cr. The said administrator claims credit for the following disbursements made out of the said estate to wit No 1. By[?] amt paid to Moses JOHNSON as per rect on file 5.00 2 Amt pd James IRELAND 3.00 Amt charged by admr for feeding mare previous to sale 6 weeks 6.00 By four notes returned to the Court on Mordica STOCKEY 100.00 Amt of W H EWING's reciept 9.96 Amt of O M CRANE Jr acct 1.06 The Admr claims for his services 5.28 ----- $130.30 Whereby it appears that there shows[?] in the hands of said administrator the sum of one hundred and thirty dollars and thirty cents and that he has paid out in claims against said estate and for expense of administration (one dollar and six cents of which is -------ed[?] into the hands of the Clerk for the use of Obidiah M CRANE Jr and retained[?] in his hands the sum of five dollars and 28 cents for his services as administrator making the expenditures equal the amount which came[?] into his hands It appearing to the satisfaction of the Court that the said Aaron STRYKER has fully discharged his duties as Administrator of the estate of John BUNNELL deceased it is ordered that he be discharged thereupon."
