I William H EWING Clerk of the Probate Court in and for the county of Jackson in the State of Indiana, do certify the annexed to be a true copy of the Last Will and Testament of Jesse B DURHAM late of the county of Jackson and State of Indiana deceased, and of the Certificate of Probate ordered therein, and Samuel T. I Jesse B DURHAM of Jackson County in the State of Indiana being in usual health and of sound mind and memory, but knowing the unceratinty of Life and the certainty of Death and being desireous of settling my worldly affairs and thereby be the better prepared to leave this world when it shall please Almighty God to call one hence" [end p. 217] [p. 218:] " 218 Do Therefore make and publish this my Last Will and Testament in manner and form following Towit ----- First--I commit my soul to the hand of God who gave it, and my body to the earth to be decently interred at the discretion of my Executor herein after named, and after my funeral expenses and all my first[?] debts are paid, and one third part of my personal property are set off to my wife I devise[?] first, I give to my beloved wife Elizabeth DURHAM the farm on which I now live, To have and to hold the same to her own use and benefit during her natural lifetime, and at her death I will and bequeath the same to my youngest son James Madison DURHAM to have the same to his own use benefit and behoof forever it being the NW qr of section twenty eight in township 5 N of R 4 east conatining 166 more or less, I also give and bequeath to the heirs of my deceased son Ewing DURHAM the farm on which he died being part of Sect 20 T5 R 4 containing eighty acres more or less, it to include 8 acres of Section 29, Whereon[?] the house stands, garden &c[?] To have and To Hold the same to their own use and benefit forever which I value to be worth six hundred dollars, I also give and bequeath to my son Harrison DURHAM a certain tract of land which I purchased of Hugh A FINDLEY containing 57 acres more or less, it being a part of sec 21 T5 N R 4 E to have the same to his use and benefit forever, which I value to be worth four hundred dollars. I also give and bequeath to my son John Bolivar DURHAM the farm lying in the half mile branch and being a part of fractional section 20 & 21 in T5 N of R 4 East with a small piece of section 28, lying on the North side of the big Road[?] containing 85 acres more or less--To have and to Hold the ssame to his own use and benefit forever, which I value at six hundred dollars, and whereas I have given to my son Hannibal and Samuel $200 each in cash, I also will and bequeath to my daughters the same amount of 200$ in cash namely Elvira and Mary Catherine DURHAM to be paid to them by my Executor out of the first money that may come to his hands after my death, I also in addition bequeath to my daughters Elvira one good bed and bedding one bureau one dress table---And in like manner I give to my daughter Mary Catherine one bed and bedding, One dining Table, one horse bridle and sadle--to my Sons John B. (if he does not receive it sooner) one bed and bedding and one cow and calf, and to enable my executor to make[?] the several sums to distribute as above, I direct him to sell all my remaining in personal property, and all of my remaining Real Estate Towit, a farm of 68 acres on the river in fraction 30 T5 Range 4 E and my undivided eight part in the North East quarter of section 29 of T5 N R4 East, called the Vallonia Tract as well as a lot of a few acres which I purchased of Samuel EWING of Mercer Co Ky in the same qr in the North East corner the whole to be sold to the best advantage at the discretion of my executor and after the disposition of my estate as above directed, and the sale money is collected, I direct that my executor divide it amonst my heirs so as to make an equal distribution among them, and if there should[?] be as much in his hands, I also wish it understood that I value my home price[?] given to James Madison at six hundred dollars, and lastly I do hereby Constitute and appoint my neighbor Henry G SMITH to be my Sole executor to this my last will and testament----In Testimony Whereof I Jesse Brigg DURHAM have to this my Last Will set my hand and seal this 7th day of July in the year of our Lord one thousand eight hundred and forty eight. Jesse B DURHAM {seal} Signed in the presence of us whose names are hereunto annexed as witnesses W BERKEY Tazwell MARSH"[end p. 218] [p. 219:] "219 A Codicil--Whereas I Jesse B DURHAM have made my Last Will and Testament in writing bearing the date of July 7th, the year one thousand eight hundred and forty eight, Whereas by the death of my son James Madison I do by this writing which I hereby declare to be a codicil to my will to be taken as a part thereof give and bequeath to my daughter Elvira the tract of land which was willed to my son James Madison Towit the N W qr of section 28 in Township 5 N of Range 4 East containing 166 acres more or less, I also will and bequeath to my daughter Mary Catherine my farm lying in the river bottom being a part of fraction Thirty containing sixty eight acres more or less Also to my son Hannibal's Widow and his heirs I will and bequeath a note which I hold on J B BERKEY not exceeding Two hundred dollars and also I direct that my executor pay to them a sum which with the note above named will amount to four hundred dollars, I also will and bequeath to my son Samuel or his heirs Four hundred dollars, the Two last named bequeaths to be paid out of a certain sum of money which is coming to my wife Elizabeth from the Estate of her deceased brother Samuel EWING ehich is deposited in the branch bank at Danville Kentucky as soon as collected, I also order and direct that my executor after all my just debts are paid shall make an equal division of what money may be left among my children, and also I do hereby constitute and appoint my son in Law Samuel T WELLS my sole executor to this my last will and testament, last it is my desire that this my present codicil be annexed to and made a part of my last will and testament to all intents and purposes--In Witness Whereof I have hereunto set my hand and Seal this Twenty Second day of September in the year Eighteen hundred and fifty Jesse Brigg DURHAM {seal} The above instrument was at the date therof declared to us by the testator Jesse B DURHAM to be a codicil to be annexed to his Last Will and Testament ------ Attending Witnesses A. [?] BURRELL Rhodes W MEAD Which said will and the codicil there to were duly approved according to Law, on the 8th day of October AD 1850 and admitted to record in the Probate Court of said county in the 9th day of October 1855, The said lands which the said Testator designed and intended should be sold are more particularly described as being the -- A portion of the Lot of land deeded to Jesse B DURHAM by Samuel EWING it being the in the North East corner of section 29 Town 5, N Range 4 East--commencing 37 1/2 Poles from the South West corner of said Lot of land, Thence, South 5oE[?] to the South East corner of said lot, Thence West to the place of beginning containing eighty and one half acres---and which said lands, the said testator owned by good fee[?] simple title at the time of his death, and which have been inventoried and appraised with the personal property and the appraisement filed in the Clerks Offis of this Hon Court and the Inventory herewith also Exhibited That the said Jesse B DURHAM deceased left as his heirs and legal representatives Susan DURHAM over the age of twenty one years and Celestis DURHAM aged thirteen years, and Hellin[?] M DURHAM aged eleven years" [end of p. 219.
