First, After my respected wife shall have taken her portion as the law directs, I give and bequeath as follows, of my property that I may be seized of at my death: To the heirs of my son, Simeon C, Two hundred dollars; to the heirs of my son Andrew McNabb, one hundred and fifty dollars; To the heirs of my son Commodore Perry, Five dollars; to the heirs of my daughter Emily A, one hundred dollars. The remainder to be equally divided between my sons, John M. Fielding G, and Madison W. after my just debts and the costs of administration shall have been paid provided that the division between the last three named shall be so made that said John M shall receive one hundred dollars from [or possibly [less] than] the other two. Second, I appoint my son, Madison W. Carpenter executor of this my last will and testament. Third I hereby revoke all former wills and bequests by me made. his Daniel x Carpenter mark The above will and testament signed and acknowledged in our my presence this 30th day of January 1865. Allen Young ?. F. Thornberry State of Indiana, County of Morgan, ss: Be it known that on the 14th day of January 1867, before me, Jarvis J. Johnson, Clerk of the Morgan Common Pleas Court, personally came Allen Young who, being duly sworn and examined, states that said decendent, Daniel Carpenter did in his presence and in the presence of Benjamin F. Thornberry on the 30th day of January 1865 sign, seal, publish and declare the foregoing writing to be his last will and testament. That said Benjamin F Thornberry and affiant signed the same as witnesses in the testator’s presence and the presence of each other. That said testator was at that time of sound mind and memory of full age to devise his property and not under coercion or restraint. Allen Young Witness my hand and the seal of said court at Martinsville this 14th day of January 1867. J.J. Johnson, clerk. State of Indiana, Morgan County, ss: I, Jarvis J. Johnson, Clerk of the Court of Common Pleas of the said county, do hereby certify that the within annexed last will and testament of Daniel Carpenter has been duly admitted to probate and duly proved by the testimony of Allen Young, one of the witnesses thereto, that a complete record of said will and of said proof has been by me duly made and recorded in Book “C” of the Record of Wills of said County. In attestation whereof I hereto set my hand and the seal of said court at Martinsville, this 14th day of January 1867 Jarvis J. Johnson, Ck.
