Davis a commissioner to carry into effect all the provisions of an act entitled an act for the benefit of persons who are likely to suffer by the distruction of the records of sd Parke county approved December 28 1832 Be it remembered that at this term of said court John Marts produced to the court certain evidences in relation to the execution & delivery of deed of conveyance from one David Johnson now deceased to him said Marts which was received by the court and admited to record as follows to wit the said John Marts being sworn in the open court upon his oath says that David Johnson late of said county deceased in his lifetime towit some time in the months of June or July in the year 1832 made signed sealed and delivered in due form of law to him said John Marts a deed of conveyance in fee simple with general warrant for a certain tract of land situated in the county of Orange State of Indiana and known and designated as the west half of the North west quarter of section mineteen (sic) Township number two North of range two East in the district of lands subject to sale at Jeffersonville Indiana containing 85 acres or there abouts that the consideration mentioned in said deed was two hundred dollars that the same was on the date thereof duly acknowledged before one Matthew Noel Esquire then and now an acting justice of the peace in and for said county of Parke and witnessed by said Noel and one Henry Slavens and by him said Marts deposted in the Recorders office of page 62 said county of Parke to be therein recorded and and was by him never taken out of said ofice and he verily believes  the said deed was destroyed by fire in the burning of the Clerks and recorders office of said county on the morning of the 12th day of November 1832 and further saith not whereupon Matthew Noel as a Esquire was introduced and sworn as a witness in this behalf who upon his oath says that he was an acting justice of the peace during the year 1832 for the county of Parke Indiana that sometime in the summer of that year by virtue of his said office he took and certified the acknowledgement of a deed of conveyance from David Johnson now deceased to John John (erased) Marts for a certain tract of land lying in Orange County Indiana the number whereof he does not now recolect but heard said Johnson say it was the same farm and tract of land whereon said Johnson had theretofore lately lived or left in said county of Orange and was supposed to contain something over eighty acres that he saw said Johnson sign seal and deliver said deed to said Marts that said deed was in due form of law with general warranty and was made to said Marts in consideration of the east part of lot number fifty eight in the town of Rockville Parke county Indiana was conveyed by said John Marts to Cynthia Johnson one of the daughters of said David Johnson and Marts was to support or assist in supporting said David Johnson during his natural lifetime and that he this deponent was one of the subscribing witnesses to said deed and further saith not.    Signed Feby 1st 1386                                      John G.
