The following will was recorded by the Putnam County Indiana clerk from a certified copy of the will of John Evans of Clark County Kentucky, who left land in Putnam County, Indiana.   Page 264  “John Evans Will – Certified Copy”   Evans John Will. In the name of God Amen, I, John Evans of Clark County do hereby make and publish this as my last will and testament.  First – I give and devise to my daughter Sally Ann Bratton, the tract of land which I purchased at the sale of the real estate of Obediah Dooley deceased and which was conveyed to me by Ellis Dean as Com= missioner, that is all of said land that has not been heretofore conveyed by me to other persons, and said Sally Ann Bratton is to have said land during her natural life, and after her death it is to belong to her children then living and the descendants of any of them that may be dead. I have heretofore giv= en said Sally Ann Bratton a Negro boy named Lewis.  Second. I give and devise to my daughter Polly Allen the wife of William W. Allen, three fourths of the tract of land Conveyed to me by James Allen & wife, the whole tract containing one hundred and sixty seven acres and forty two hundredths or thereabouts, the other fourth part of said tract be= longs to said William W. Allen who now resides upon said land, and said Polly Allen is to have the land hereby devised to her during the term of her natural life, and at her death, I give it to her children then living and the descendants of any of them that may have died; said land is situated in Putnam County Indiana.  Third, I have given my son John money and property equal in my estimation to what I have given to my daughter in the foregoing devises to them.  Fourth. I give and be= [illegible …] Thomas J. Evans the tract of land conveyed to my […illegible] his heirs, that is all that tract of land except about fourteen acres and three quarters that was lost by my father in his life time by a suit brought against him on an adverse title, and said Thomas J Evans is to have said land during his natural life and at his death I give it to his children then liv= ing and the descendants of any of them that may have died and I also give said Thomas J Evans a Negro boy named Henry.  Fifth I also devise to my daughter Polly Allen the sum of Five hundred dollars and said Five hundred dollars is to remain in the hands of my Executor, hereafter named for the benefit of my said daughter Polly, and it is to be used by them as her trustees in whatever way they may think it most to her advantage. Sixth. I own other land which belonged to my father and which I purchased of his heirs after his death, and I will it and all other balances of my estate of every description which I own at my death, to be equally di= vided among my four children, after the payment of my debts and the expen= ses of Administrators, but this division if not to take place until after the death of my wife, to whom I give during her natural life, all the land not specifically devised to my two daughters and to my son Thomas, and I also give unto her during her natural life the slaves, Andy, Betty and Jefse, But said Andy’s to be free under my father’s will at the age of thirty nine years. I also leave my wife during her life all my household and Kitchen furniture, and also two mares, two cows, and such farming implements as she may wish to keep, and also as may [sic] hogs as may be necefsary to furnish her with meat, and so much provisions including meat and breadstuff as may be necefsary for her support for a year, and corn enough to keep her stock dur= ing a year. When Andy becomes free he is to be paid one hundred dollars. Page 265 Out of the money arising from the sale of my stock after my death, which is not contained in the devise to my wife. My slaves Eliza, Mary, and Martha and all other property belonging to me not herein heretofore willed, I direct to be divided among my four children equally first paying my debts out of the same if any.   I hereby appoint my two sons John Evans and Thomas J Evans and my son-in-law David Bratton the Executors of this my last will and testament. Witnefs my hand this 30th day of October 1861.  John Evans. Attest. Jams Simpson Jas. C. Brown (Proof) “Clark County Court, February Term 1st day of March 1870 A wri= ting purporting to be the last Will and Testament of John Evans deceased and this day produced in open Court, and proved according to law by the oaths of James Simpson and Jos. C. Brown subscribing witnefses whereof and adjudged by the Court to be the true last will and testament of said John Evans deceased, and ordered to be recorded, the same being duly stamped with Internal Revenue stamp of the denomination of $7“/“ as requested by Act of Congrefs. Att. Cert. John Catherwood Clerk “State of Kentucky, Clark County I, E.W. Combs, Clerk of the Clark County Court, do certify that the fore= going writing is a true copy of John Evans, deceased, will, which will is re= corded in my office in Will Book A pages 195 and 196. Witness my hand and seal of office at Winchester, Kentucky, February 26, 1878 E.W. Combs Clerk {LS}” State of Putnam County} SS.       The foregoing certi= fied copy of will filed and recorded in pursuance of an Order therefore entered in Probate Order Book, No. 15, page 101 and I certify that this foregoing is a true and complete copy of said certified copy of said last Will and Testament of said John Evans, deceased, and proof and certificate of Pro= bate thereof.
