Deed of Jacob Surber Recorded in Shelby Co., Indiana      This Indenture made this twentieth day of December in the year of our Lord one thousand eight hundred and thirty eight.  Between Jacob Serber Catharine Serber his wife of the County of Shelby and State of Indiana of the one part and Peter Fensler of the county and state aforesaid of the other part.    Witnesseth that the said parties of the first part for and in consideration of the sum of one hundred and fifty dollars Lawful money of the United States to them in hand paid by the said party of the second part the receipt whereof is hereby acknowledged by the said party of the first part hath bargained and sold and by there presents doth grant bargain and sell unto the said party of the second part and his heirs and assigns forever all that parcel or tract of land to Wit the North east Quarter of the South West Quarter of Section Thirty five in township fourteen North of Range five East in the district of Lands sold at Indianapolis Indiana containing more or less.      To have and to hold the above described premises hereby sold and conveyed unto the said Peter Fansler his heirs and assigns forever together with all and singular the appurtenances thereunto belonging or in any way appertaining to his own proper use and behalf.  And the said Jacob Serber and Catharine Serber for themselves their heir executor and administrator the aforesaid lot or tract of land and the appurtenances to the said Peter Fansler his heirs and assigns against the claim or claims of all and every person or persons whomever Will Warrant and forever defend.      In testimony whereof the said Jacob Serber and Catherine Serber his wife have hereunto set their hands and affixed their seals the day and year first above written.                                                            his                                                   Jacob           Serber                                                            mark Signed Sealed and delivered in the presence of             her            Peter Geatts                           Katharine      Serber            Samual ergen                                    mark State of Indiana Shelby County      Be it remembered that before me the undersigned a Justice of the Peace of said County personally appeared Jacob Serber and acknowledged the deed of conveyance to which this is annexed to be his act and deed for this purpose therein mentioned.      And the said Catharine Surber the wife of the said Jacob Surber being seperately examined apart from her said husband and the full contents and purport of the above deed being made known to her she did declare that she did voluntarily and of her own free will and accord and as her act and deed seal and deliver this said Deed and Conveyed  on without any coercion or compulsion from her husband and that she relinquished all her right and title of Dower in the premises.      Given under my hand and seal the twentieth day of December 1838.                               Wm.
