In the name of the Benevolent Father of all I Jeremiah Cory of Union County and State of Indiana do make and publish this my last Will and testament. Item 1st. At my decease I wish and will that my personal property of which I may be possessed of at the time with the exception of my beloved wifes dowery (if she be living at the time) be sold at public sale as the law directs and after defraying funeral expenses and paying my just debts I direct the balance of the proceeds of said personal property be equally divided among my daughters or their children if any should decease previous to that time. Item 2nd. If my beloved wife Rebecca be living at my death I bequeath to her the farm at which we now live situated in Harmony Township Union County Ind to have and to hold during her life time together with all the rents and profits arriving therefrom. I also request and ordain that my daughter Catharine Cory have a home with her mother on said farm jointly during her mothers natural life. Item 3rd. At the death of my beloved Wife I bequeath to my sons Elnathan K Cory and Moses W Cory all the Real Estate of which I may be possessed at my decease also I ordain that the same be divided as hereinafter described to wit: Sixty acres of the North part off the aforesaid farm, a line to be run East & West so as to portent off said Sixty acres which I bequeath to my son Elnathan K Cory and the South part of said farm I bequeath to my son Moses W Cory on the condition that they pay the following legacies to wit: To John Rich two hundred dollars upon the following conditions if the said John shall stay with the family until the 1st day of January 1866. To my sons Samuel S Cory and Silas H Cory twenty dollars each having heretofore advanced to my sons Samuel and Silas an equitable Share of my earthly effects. Item 4th. The foregoing bequest to my son Moses W Cory are expressly upon the following conditions to wit that he make ample provisions for the comfort & Sustainance of his mother and his sister Catharine Cory during their natural lives. Item 5th. I hereby appoint my two sons Elnathan K Cory and Moses W Cory the Executors of this my last Will and testament. In testimony hereof I have set my hand seal this 3rd day of February 1865. signature - Jeremiah Cory (seal) Signed and acknowledged by the said Jeremiah Cory as his last will and testament in our presence and signed by us in his presence. Be it remembered That on the 25th day of June 1874 Ira Foster one of the subscribing witnesses to the within and foregoing last Will and Testament of Jeremiah Cory late of said County deceased personally appeared before the Clerk of the Circuit Court of Union County in the state of Indiana and being duly sworn by the Clerk of said Court upon his oath declared and testified as follows that is to say that on the Third day of February 1865 he saw the said Jeremiah Cory sign his name to said instrument in writing as and for his last will and testament and that this deponent at the same time heard the said Jeremiah Cory declare the said instrument in writing to be his last Will and Testament and that the said instrument in writing was at the same time at the request of the said Jeremiah Cory and with his consent attested and subscribed by the said Ira Foster and Benjamin Wooters in the presence of the said testator and in the presence of each other as subscribing witnesses thereto and that the said Jeremiah Cory was at the time of the signing and subscribing of said instruments in writing as aforesaid of full age (that is more than twenty one years of age) and of sound mind and memory and not under any coercion or restraint as the said deponent verily believes and further deponent says not. signature - Ira Foster Sworn to and subscribed by the said Ira Foster before me W M Casterline Clerk of said Court at Liberty the 26th day of June 1874. signature - W M Casterline, Clerk In attestation whereof I have hereunto subscribed my name and affixed the seal of said Court. signature - W M Casterline, Clerk State of Indiana Union County SS. I W M Casterline Clerk of the Circuit Court of Union County Indiana do hereby certify that the within annexed will and Testament of Jeremiah Cory has been duly admitted to probate and duly proved by the testimony of Ira Foster one of the subscribing witnesses thereto, that a complete record of said Will and of the testimony of the said Ira Foster in proof thereof has been by me duly made and recorded in Book B at pages 40, 41, 42 of the Records of Wills of said County.
