Kansas In the name of God Amen I Thomas Harkness of Lone elm? township county of Anderson State of Kansas do hereby make publish and declare this to be my Last Will and Testament. 1. I direct my executor to pay all of my just debts and funeral expenses and to put up at my grave a plain tomb stone upon which is to be carved on ?? the words he was a soldier in the Union Army Co. F 34th Ill Vol War of 1881 & 1865 2. I give and bequeath to my grand son Daniel Harkness one hundred dollars ($100.00) 3. I give grand daughter Hessie Harkness fifty ($50.00) both of the above named living in Hardin County, Iowa 4th I give to my Grand daughter Lula Harkness of Mt. Sterling Illinois fifty dollars ($50.00) 5th I give to Jennie Hamilton of Anderson Co. KS fifty dollars ($50.00) 6th I give to Lilie? Corbin formerly Lilie? Hamilton of Linn? Co. Kas fifty dollars ($50,00) 7th The residue of my Estate I give to my daughter Margaret Hamilton of Anderson County Kas. I appoint William Simpson of Linn? County Kansas and J. G. Lindsey of Anderson County Kansas my executors of this my Last Will and I do earnestly desire them to make it their special care that this my last will is carried into effect with the least possible cost In witness whereof I have hereunto set and ??? seal and publish and declared this instrument of writing to be my last will and testament this 9 day of March A. D. 1883 in the presence of the persons whose names are subscribed as attesting witnesses Thomas Harkness On this 9th day of March A D 1883 the above named Thomas Harkness in our presence signed the foregoing instrument of writing and published declared to us that it was his last will and testament and requested us to subscribe our names thereunto as witnesses and we in his presence and in the presence of each other in compliance with such request have hereunto subscribed our names. Kirk Manford Schoonover Proof of Will of Thomas Harkness Dec'd State of Kansas} Anderson County} In the probate court of said county in the matter of proving the Will of Thomas Harkness Dec'd Now on this 2nd day of February A D 1884 comes L. K. Kirk who being first duly sworn upon his oath sayeth My name is L. K. kirk, My residence is Garnett, Kas. age of 42 years I was aquainted with Thomas Harkness a resident of Garnett, Kansas about 5 years in his later times I was present at Garnett Kas on the 9th day of March A. D. 1883 and saw the said Thomas Harkness sign the foregoing instrument of writing, purporting to be the last will and testament of the said Thomas Harkness and heard him publish and declare the same to be his last will and testament and at his request and in his presence and in the presence of Manford Schoonover I signed said instrument as a subscribing witness thereto. And the said Manford Schoonover at the request of said Thomas Harkness and in his presence and in my presence signed said instrument as a subscribing witness thereto At the time of signing said instrument said Thomas Harkness was about 60 years of age he was of sound mind and memory and was not under any restraint or under any influence whatever Said Thomas Harkness is not dead, he departed this llife on the 21st day of January A D 1884 L. K. Kirk subscribed and sworn to before me this 3rd day of February A D 1884 J. W. Vaughn Probate Judge Also came Manford Schoonover of lawful age who being first duly sworn upon his oath saith my name is Manford Schoonover, My residence is Garnett Kansas, My age is 25 years, I was aquainted with Thomas Harkness a resident of Anderson County Kansas about 3 years in his life time I was present at Garnett Kansas on the 9th day of March 1884 and saw the said Thomas Harkness sign the foregoing instrument of writing purporting to be the last will and testament of the said Thomas Harkness and heard him publish and declare the same to be his last will and testament and at his request and in his presence and in the presence of L. K. Kirk. I signed said instrument as a subscribing witness thereto and the said L. K. Kirk at the request of said Thomas Harkness and in his presence and in my presence signed said instrument as a subscribing witness thereto At the time of signing said instrument said Thomas Harkness was about 60 years of age, he was of sound mind and memory and was not under any restraint or undue influence whatever Said Thomas Harkness is now dead he departed this life on the 21st dayh of January A D 1884 Monford Schoonover subscribed and sworn to before me this 2nd day of Feb.
