Jay, of lawful age, being first duly sworn, on her oath deposes and says: I was well and personally acquainted with David L. Mize in his life time; that David L. Mize was on or about July 9th, 1868, in the county of Jackson state of Kansas, married to Margaret Rice; that David L. Mize lived with his said wife Margaret from the date of their marriage, without separation or divorce, until the death of said Margaret Mize, on or about August 10, 1875; that said David L. was not remarried to any one from the date of the death of said Margaret Mize, until July 3rd, 1881, when he was married to Mary E. Babcock, in Jackson county, Kansas; that David L. Mize lived with his wife, Mary E. Mize, from the date of their Marriage, without separation or divorce, until the day of his death; that said David L. Mize died on or about the 24 day of March 1914, leaving his widow, Mary E. Mize, him surviving. I am 65 years of age, and my post office address is Atchison, Kansas, R. F. D. No. 2. And further affiant saith not. (signed) Mrs. Emily C. State of Kansas, Brown County, SS: Mary E. Mize. of lawful age, being first duly sworn, on her oath, deposes and says: I am 60 years of age, and am a resident of Brown County, Kansas; my post office address is Fairview; I was on the 18th day of January 1879, married to James P. Babcock in Shawnee County, Kansas; I lived with my husband, James P. Babcock, from the date of our marriage, with separation of divorce, until the day of the death of said James P. Babcock, which was on or about May 11, 1879; that I was not intermarried with any one from the date of the death of said James P. Babcock, until July 3, 1881, when I was married to David L. Mize; that I lived with my husband David L. Mize, from the date of our marriage, without separation or divorce, until the day of the death of said David L. Mize, which was on the 24 day of March 1914. That said James P. Babcock never served in the military or naval service of the United States; that I was never married prior to my marriage to James P. Babcock, but am unable to furnish additional testimony on that point, for the reason that I do not know, and with diligence have been unable to ascertain, the address or whereabouts of any persons who knew me prior to my marriage to James P. State of Kansas, Shawnee County, SS: Mrs. Jennie Antrim of lawful age, being first duly sworn, on her oath deposes and says: I am 49 years of age, and a resident of Shawnee county, Kansas; my post office address is, N. Topeka R. R. 6; I am, and have been for the past all my years life, well and personally acquainted with Mary E. Mize, widow of David L. Mize; that Mary E. Mize was formerly the wife of James P. Babcock, having been married to him on or about January 18, 1879; that said James P. Babcock died on or about May 11, 1879, leaving his widow, Mary E. Babcock, him surviving; that said Mary E. Babcock was not remarried to any one from the date of the death of said James P. Babcock, until July 3, 1881, when she was married to David L. Mize; that Mary E. Mize lived with her husband, David L. Mize from the date of their marriage, without separation or divorce, until the day of the death of said David L. Mize; that said David L. Mize died on or about the 24 day of March 1914, leaving his widow, Mary E. Mize, him surviving. And further affiant saith not. State of Missouri, Carroll County, SS: Henrietta Kimble, of lawful age, being first duly sworn on her oath deposes and says: I am 54 years of age, and a resident of Carroll county, Missouri; my postoffice address is Hale, Missouri; I am, and have been for the past 50 years, well and personally acquainted with Mary E. Mize, widow of David L. Mize; that Mary E. Mize was formally the wife of James P. Babcock, having been married to him on or about January 18, 1879; that said James P. Babcock died on or about Mary 11, 1879, leaving his widow, Mary E. Babcock, him surviving; that said Mary E. Babcock was not remarried to any one from the date of the death of said James P. Babcock, until July 3, 1881, when she was married to David L. Mize; that Mary E. Mize lived with her husband, David L. Mize from the date of their marriage, without separation or divorce, until the day of the death of said David L. Mize; that said David L. Mize died on or about the 24th day of March 1914, leaving his widow, Mary E. Mize, him surviving. And further affiant saith not. (signed) Henrietta Kimble Subscribed and sworn to before me this 8th day of January, 1915. Neighbor's Affidavit, Act of June 27, 1890. State of Kansas, county of Shawnee, ss: In claim of David L. Mize late of Company A, 17th Regiment of Kansas Infantry Volunteers, personally appeared before me, the undersigned, duly authorized to administer oaths within and for said County and State, Andrew J. Mize aged 29 years; and Thomas Bragg aged 68 years; residents of North Topeka and Elmont, in the County of Shawnee and State of Kansas, well known to me to be respectable and entitled to credit, and who, being duly sworn, declare in relation to the aforesaid case, as follows: That they have been well and intimately acquainted with David L. Mize for 22 years and 27 years respectively, and that he is the identical person he represents himself to be, and that he is, and has been, during our acquaintances with him, since his discharge from the Army, disabled for the performance of manual labor for three fourths of his time in consequence of his disabilities of rheumatism, diseased eyes, heart troubles, rupture of left groin and disabled right index finger and resulting disabilities, which are not due to vicious, bad or intemperate habits, and that he believes are of a permanent character. Affiants further states they have no interest direct or indirect to his claim, etc. the information they give were derived from a close and intimate acquaintance with he claimant, as a neighbor, form 1865 to the present time. State of Kansas, County of Shawnee, ss: In the matter of Claim for _____ Pension Act June 27, 1897 of David L. Mize, late of Co. A 17 Regt. Kansas Infantry Volunteer. On this 11 day of July 1900, personally appeared before me, a Notary Public in and for the aforesaid county, duly authorized to administer oaths, David L. Mize aged 54 years a resident of Fairview, in the county of Brown and state of Kansas. That he is the above named claimant that since he made his claim for Inc. of Pension he has moved from Elmont, Kansas, to Fairview, Kansas and he would like to have the Pension commissioner to have his address changed so that his papers will come to him to his new address and he asks that his Inc claim be adjudicated as soon as possible. Sir: In forwarding to the pension agent the exectued voucher for your next quarterly payment please favor me by returning this circular to him with replies to the questions enumerated below. Very Respectfully, Commisioner. (The following questions were answered by David L. Mize) First. Are you married? If so, please state your wife's full name and her maiden name. Answer: yes, Mary Elisabeth. maiden name, Rose. Second. When, where, and by who were you married? 3d of July 1881, South Cedar, Jackson County, Kansas, by E. P. Jones, a minister. Third: What record of marriage exists? Answer: We hold marrige license. Fourth. Were you previously married? If so, please state the name of your former wife and the date and place of her death or divorce. Answer: yes. Margaret. Died, August 10, 1879, at Morril, Brown County, Kansas. Fifth. Have you any children living? If so, please state their names and the dates of their birth. Answer: Five. Mize Date of reply May 4th, 1898. Under Act of June 27, 1890. Declaration for Invalid Pension. State of Kansas, County of Shawnee, ss. On this 12th day of February, A. D. one thousand eight hundred and ninety two, personally appeared before me. Robert S. Bell a Notary Public within and for the county and State aforesaid, David L. Mize, aged 45 years, a resident of Shawnee County, Kansas, who being duly sworn according to law, declares that he is the identical David L. Mize, who was enrolled on the 20th day of July, 1864, in Co A. 17th Regt. Kansas Inf. Vol. as private in the war of the rebellion, and served at least ninety days, and was honorably discharged at Ft. Leavenworth, Kansas on the 16th day of November, 1864. That he is unable to earn a support by reason of rheumatism of back, left hip and entire left leg which has trouble almost continously for past ten or twelve years, also disease of eyes causing dimness of vision which came upon him at about the same time his rheumatic trouble did. He knows of no cause as he had received no direct injury to his eys or prior ___, to his knowledge, also has heart trouble and the resulting disabilities. He also suffers with a rupture in left groin which he incurred prior to his army service by overstraining and heavy lifting when about 12 or 14 years of age. Also a disabled right index finger sustained in infancy. That said disabilities are not due to his vicious habits, and are to the best of his knowledge and belief permanent. That he has never applied for pension. That he has never been in the military of naval service of the U. S. except as above stated. That he makes this declaration for the purpose of being placed on the pension roll of the United States, under the provisions of the Act of June 27, 1890. He herby appoints with full power of substitution and revocation Patrick H. Coney, of Topeka, State of Kansas, his true and lawful attorney to prosecute his claim, the fee to be Ten Dollars as prescribed by law. Ceoney Act of February 8, 1907, Declaration for Pension. State of Kansas, County of Brown, SS: On this 13 day of July, 1908, personally appeared before me a Notary Public within and for thecounty and state foresaid, David L. Mize, who, being duly sworn according to law, delcares that he is 62 years of age, and a resident of Fairview, County of Brown, State of Kansas; and that he is the identical person who was enrolled at Fort Leavenworth, Kansas, under the name of David L. Mize on the ___ day of July, 1864 as a Private, in 17 Reg Kansas Vol. Infantry ( Co. A ) in the service of the United States in the Civil war, and was Honorably Discharged at Fort Leavenworth, Kansas, October 1864, that he had no other service record. That he was not employed in the military or naval service of the United States otherwise than as stated above. That his personal description at enlistment was as follow: Height, 5 feet 8 1/2 inches; complexion Light; color of eyes, Black; color of hair, Black; that his occupation was Farmer; that he was born July 11, 1846 at Davis County, Missouri. (Please note, I believe the handwriting said Davis County, Missouri) That his several places of residence since leaving the service have been as follows: 1865 in South Cedar, Jackson County, Kansas; 1874 Elmont, Kansas; 1898 to Fairview, Brown County, Kansas where I have since resided. I am on Pensioner Certificate No. 843875 That his post office address is Fairview, county of Brown, State of Kansas. (signed) David L. Mize Witnesses were W. H. Meyer and H. J.
