B. Kirkland. Marshal Troth and Deputy Charles Rupp, went to the home of John Goetz, armed with a warrant for Goetz and wife, John Doe and Richard Roe. W. B. Kirkland was there, defied the officers, and moved his right hand to his pistol pocket in a threatening manner. The marshal who had been threatened many times by Kirkland, fearing that his life was in danger, fired three times, with the above result. The marshal immediately gave himself up to the sheriff. The officers secured considerable quantities of intoxicating liquors. During the shooting John Goetz ran away and is still at large. Coroner Marty held an inquest Saturday morning. Following is the verdict of the jury: State of Kansas, Ellis county, ss: An inquisition at Hays City, in Ellis county, on the 6th day of May,1911, before me, L. A. Marty, coroner of said county, on the body of W. B. Kirkland there lying dead, by the jurors whose names are hereunto subscribed. The said jurors, upon their oaths, do say that the said W. B. Kirkland, came to his death by reason of and caused by gun shot wounds inflicted by one John Troth, city marshal of Hays City, Kansas, in attempting to arrest the said W. B. Kirkland; that such killing was not felonious but was a necessary and justifiable act of said Troth in the performance of his duty as an officer. In testimony whereof, the said jurors have hereunto set their hands the day and years aforesaid. Frank Stout, W. E. Stone, P. P. Smith, C. S. Lasure, Fred Miller, Alex Laltegan. Attest: L. A. Marty, M.D., Coroner. Kirkland's body was taken to Havemann's undertaking rooms and prepared for burial. Funeral services were held from the Kirkland home Saturday afternoon, Rev.
