Dorner, Deceased ) No. 4433 Decree of Descent On this 21st day of November ... [faded] ... petition of Effie M. Dorner for the determination of descent of the real estate hereinafter described comes on for hearing before the court. The court finds that notice of said hearing has been given as required by law and the order of the court, and that proof thereof has been duly filed in said court, all of which the court approves and confirms. The parties appear as follows: Effie M. Dorner by Fleming, Haag, Seffels and Hope, her attorneys. There are no other appearances. Thereupon, evidence is introduced in behalf of the petition and the court finds that the allegations thereof have been duly proved; that the decedent died intestate on the 6th day of August, 1964; that at the time of his death the decedent was a resident of Finney County, Kansas, and was the owner of Lot One (1), Block Four (4), Oldfield Park Addition to the City of Garden City, Kansas; that the decedent has been dead for more than one year prior to the filing of the petition herein; that no will of the decedent has been admitted to probate nor administration had of his estate in the State of Kansas; that all inheritance taxes by virtue of the descent of said real estate from the decedent have been determined and paid; that the following persons are all of the heirs of the decedent: (1) Effie M. Dorner, his wife, who is of legal age and whose residence and post office address is 1006 North Third Street, Garden City, Kansas; (2) Phillip Dorner, his son, who is of legal age and whose residence and post office address is 5208 Richey Road, Yakima, Washington; (3) Darlene Bryant, his daughter, who is of legal age and whose residence and post office address is 178 No. Boulevard St James, Long Island, New York; (4) Billie Ann Miles, his daughter, who is of legal age and whose residence and post office address is Box 126, Syracuse, Kansas; (5) Warren J. Dorner, his son, who is of legal age and whose residence and post office address is 1006 North Third Street, Garden City, Kansas. It is therefore by the Court Decreed that the above described real estate and all other real property owned by the decedent at the time of his death within the State of Kansas, subject to any lawful disposition thereof heretofore made, be and the same is hereby and assigned to and vested in the following named persons in the proportions or part set forth: (1) Effie M. Dorner, an undivided one-half thereof; (2) Phillip Dorner, an undivided one-eighth thereof; (3) Darlene Bryant, an undivided one-eighth thereof; (4) Billie Ann Miles, an undivided one-eighth thereof; (5) Warren J. Dorner, an undivided one-eighth thereof. The court further finds that neither of the heirs set forth in this decree is in the military service as that term is used under the Soldiers and Sailors Civil Relief Act of 1940 as amended. It is therefore by the Court considered, ordered and adjudged That the findings herein made constitute and are a part of the judgement and decree of this court; that the said real estate and all other real estate owned by the decedent at the time of his death be and the proportions above set forth; that the said persons constitute and are the only heirs of said decedent, that he said real property, descended to them in said proportions and they are the owners of said respective portions subject to any lawful disposition thereof made. Dorner County of Finney Decedent died Intestate August 5, 1964 ORDER Upon regular application having been filed by interested parties the Director of Revenue, Department of Revenue, hereby assumes original jurisdiction of the above estate. The Director of Revenue finds that at date of death decedent's estate consisted of property within the jurisdiction of the state of Kansas described and valued as follows: Personal property ............................................... $0.00 Oldfield Park Add. ........................................... $1500.00 Total value estate .......................................... $1500.00 Debts, expenses of administration, etc., allowed ........... $1000.00 Remainder constituting the tax base ........................ $ 500.00 From the evidence filed it is determined that the property passes to beneficiaries as follow: Effie M. Dorner, widow Phillip Dorner, son Darlene Bryant, daughter Billie Ann Miles, daughter Warren J. Dorner, son It is therefore, by the Director of Revenue on this 2 day of November 1966 ordered, that no tax is chargeable against the succession to any part of the estate, and that a certified copy of the order of the Director of Revenue, to that effect, be issued as provided by law. ------------------ State of Kansas ) In the Probate Court in and for Finney County ) said County and State In the Matter of the Estate ) of Wm. J. Dorner, Deceased ) No. 4433 Proof of Mailing Notice of Hearing and Non-Military Affidavit A.M. Fleming, being first duly sworn, deposes and says: That he is one of the attorneys for the Petitioner in the petition upon which the attached notice is based; that on the 28th day of October, AD 1966, he mailed a true copy of such notice to each of the heirs, devisees, and legatees whose name and address are known to Affiant, by enclosing such copy in a sealed envelope, postage prepaid, properly addressed to each of the following named persons, and depositing the same in the United States Mails in Garden City, Finney County, all after having exercised due diligence in the premises: Effie M. Dorner, 1006 North Third Street, Garden City, Kansas; Phillip Dorner, 5208 Richey Road, Yakima, Washington; Darlene Bryant, 178 North Boulevard St. James, Long Island, New York; Billie Ann Miles, Box 126, Syracuse, Kansas; Warren J. Dorner, 1006 North Third Street, Garden City, Kansas. Affiant further says that neither of the heirs, devisees and legatees above named, or any other person interested in said estate, or either of them, is in the Military Service, as that term is used in the Soldiers' and Sailors' Civil Relief Act of 1940 and Amendments thereto.
