Worthington, Deceased. To the Hon: D. Felgar Probate Judge Your petitioner Philip Lander, would respectfully represent to this Honorable Court that Linford E. Worthington died on the 2nd day of February 1888 leaving a Last Will and Testament, signed by Maggie Schriver and J. W. Ady as subscribing witnesses thereto: that Philip Lander is named in the said Last Will and Testament as executor thereof. Your petitioner would therefore pray and order from this Court admitting said Will to probate, and that said witnesses be brought before this Court to testify in said matter. Philip Lander Subscribed and sworn to before me this 7th day of February, 1887 D. Felgar Probate Judge ORDER GRANTING PROBATE OF WILL State of Kansas } County of Harvey} In the Probate Court In the Matter of Probating the Last Will and Testament of Linford E. Worthington, Deceased. AND NOW on this 7 day of February, 1888 comes Philip Lander and represents to this Court that Linford E. Worthington died testate on the 2 day of February, 1888 and that Maggie Schriver and J. W. Ady are the subscribing witnesses to his Last Will and Testament: that Philip Lander is named in said Last Will and Testament of said Linford E. Worthington as executor thereof. IT IS THEREFORE ORDERED, ADJUDGED, AND DECREED, that said Last Will and Testament be admitted to Probate, and that Maggie Schriver and J. W. Ady subscribing witnesses thereto be required to appear in open Court and testify in said matter. WITNESS my hand and seal this 7th day of February, 1888 D. Felgar Probate Judge In the name and by the Grace of Almighty God, I, Linford E. Worthington of Newton, Harvey County Kansas, do make and publish this my last Will and Testament. Item I.- At my death my Executor shall pay out of my estate all my just debts, costs and expenses of last sickness, costs and expenses of my funeral and of a monument to mark my resting place. Item II.-- I do give and bequeath to my beloved wife Emma M. Worthington and my infant daughter Ruba E. Worthington all my estate and property both real and personal and whether in possession or expediency to be divided as follows: one half to my wife and the use, interests, rents and profits of the other remaining one half during the minority of my said child, to my said wife the other remaining one half and the value thereof as the same shall be ascertained upon the full settlement of my estate. I do give and bequeath to my said daughter Ruba E. Worthington to be paid to her without interest or profit upon her arriving at full age. Item III.--I do nominate and appoint my said wife guardian of the person and estate of my said child during it's infancy. Item IV--I do nominate and appoint Phillip Lanford of Newton Harvey County Kansas, Executor without bond of this my last Will and Testament, giving unto my said executor full and complete power to sell and convey any property of which I may die seized; also to receive and receipt for moneys due or to become due me and to do all acts whatsoever necessary to the full and complete settlement of my estate in pursuance of this will. Item V-- I hereby revoke all former Wills by me made In witness whereof I have hereunto set my hand and this 30th day of January 1888 in the presence of Maggie Schriver and J. W Ady subscribing witnesses hereto. Linford E. Worthington Testator We and each of us hereby certify that the foregoing instrument of writing was subscribed by the testator in our presence and that he declared the same to be his Last Will and Testament.
