Gray, 1898: Altamont, Labette County, Kansas Contributed for use in USGenWeb Archives by C. Hahn RECORD OF WILLS. PAGE 164 Will of Joseph M. Gray. Know all men by these presents: That I Joseph M. Gray of Altamont in the County of Labette and State of Kansas being in ill health and of sound and dis__sing mind and memory do make and ordain my last will and testament in manner following viz. 1st My will is that all my just depts and funeral expenses shall be paid by my Executors hereinafter and out of my personal estate as soon as after my decease as shall be by them be found convenient. 2nd I give and bequeath to my beloved wife Martha Agnes Gray all my personal property after expenses heretofore named have been paid and the annual rent of one third of all the pro____ of the North East quarter and the South half of the South East quarter of Section Twelve (12). Township Thirty four (34). Range Nineteen (19). East of the 6th P.M. during her natural life, to be delivered on the East half of the North East quarter of Sec. 12. 34. 19. 3rd I give and bequeath to my son George W. Gray the East half of the South East quarter of Sec. 12. Town 34. Range 19. East with all the profits income and advantages that may result therefrom over and above taxes and the rents to my wife Martha Agnes Gray, as heretofore specified and after the death of wife to have and to hold the same to the said George W. Gray, his heirs and assigns to his and their use and behalf forever. 4th I give and bequeath to my daughter Minnie C. Bryner the West 1/2 of the North East quarter of Section No. 12. Township 34. Range 19. with all the profits income and advantages that may result therefrom over and above taxes and the rents to my wife Martha Agnes Gray as heretofore specified and after the death of wife to have and to hold the same to the said Minnie C. Bryner, her heirs and assigns to her and their use and behalf forever. 5th I give and bequeath to my daughter Aggie E. Gray, the East half (1/2) of the North East quarter 1/4 of Section No. 12. town No. 34. Range No. 19. east with all the profits income and advantage that may result therefrom over and above taxes and the rents to my wife Martha Agnes Gray as heretofore specified and after the death of said wife to have and hold the same to the said Agnes E. Gray, her heirs and assigns to her and their use and behalf forever. 6th The above discribed lands as d__rsed being situated in Labette County Kansas. And lastly I do nominate Charles R. Lear and Gibson Torbert to be the executors of this my last will and testament without Bond. In witness where of I have hereunto set hand and seal the 31st day of May 1898. Joseph M. Gray. To the Probate Court of Labette County Kansas: YOUR PETITIONER, C.R. Lear respectfully shows that he is a resident of Hackberry Township in Labette County, Kansas; That Joseph M. Gray late of said County, died testate at Altamont in said County, on the 21st day of July 1898. That said deceased in his life time, while of sound mind and memory, and not under any restraint, being possessed of real and personal property in this County, did on the 31st day of May 1898, excute and publish his last will and testament in the presence of two attesting witnesses, who subscribed their names as witnesses, and whose names and residences are as follows: A.R. Davis, and C.S. Newton, both of Altamont Labette County Kansas. Your Petitioner represents that said testator in said will appointed C.R. Lear, & Gibson Torbert as executors___ thereo_ without Bond. That the personal estate of said deceased is of the probate value of $300.00 As your petitioner is informed and believes, the names and residences of the heirs of said deceased are as follows: Martha Agnes Gray, widow, George W. Gray, son, Minnie Bryner, daughter, and Aggie E. Gray, daughter, a minor 14 years old, all of Labette County Kansas. That said will is herewith presented to the court. Your petitioner prays that the testimony of said attesting witnesses may be taken. That said will may be admitted to probate and recorded; That Charles R. Lear and Gibson Torbert may be appointed as Executors of said will. C.R. Lear STATE OF KANSAS LABETTE COUNTY Charles R. Lear on oath says he made the foregoing petition; That the matters stated in said petition are true. Subscribed and sworn to before me this 27th day of July 1898 (Probate Seal) Daniel Pfaff, Probate Judge STATE OF KANSAS LABETTE COUNTY IN PROBATE COURT. Testimony taken on the application to admit to probate the last will and testament of Joseph M. Gray, deceased C.S. Newton being first duly sworn, testifies as follows: My name is C.S. Newton, my residence is Altamont, my age is 39 years and by occupation I am Physician. I was acquainted with Joseph M. Gray in his life time; he resided in Altamont Kansas on May 31st 1898, at Altamont Kansas I saw said Joseph M. Gray sign his name to the paper now in court, purporting to be the last will of the said Joseph M. Gray. After signing said instrument he declared the same to be his last will and testament, and requested C.S. Newton and R.A. Davis to subscribe the same as attesting witnesses, which we did in his presence and in the presence of each other. Said will is now in the same condition as when it was thus executed. At the time of signing said will said Joseph M. Gray was about 70 years old, was of sound mind and memory, and was not acting under any restraint or undue influence. said Joseph M. Gray in his life time; he resided in Altamont Kansas on May 31st 1898, at Altamont Kansas I saw said Joseph M. Gray sign his name to the paper now in court, purporting to be the last will of the said Joseph M. Gray. After signing said instrument he declared the same to be his last will and testament, and requested C.S. Newton and R.A. Davis to subscribe the same as attesting witnesses, which we did in his presence and in the presence of each other. Said will is now in the same condition as when it was thus executed.
