Private Secretary Henry Allen met the First Cavalry as it charged up San Juan hill, and recognized Lavey. After the fighting was over Allen hunted Lavey up and found that his time had expired, and that he was about to enlist. "Why don't you leave the army and go back to Kansas?" asked Allen. "Get me a job and I will." Lavey replied. "I'll do it." Said Allen So they came back to Kansas together, and when the Republican administration went into effect Allen landed Lavey in a position as guard at the penitentiary. Lavey was reputed to be a good soldier, believed in strict discipline and thought everybody else shoud. He soon discovered that the penitentiary was not run to suit him, and began to quarrel with the officers. When the war broke out in China he said he guessed he would rather fight for the flag than guard convicts in the penitentiary, so he resigned and re-enlisted in the army. He is now in San Francisco and will shortly sail for the Orient.
