CRAWFORD WILL In the Name of God, Amen. I, William D. Crawford of Sedgwick County, Kansas, being of full age and of sound mind and memory and of disposing intention, do make, publish and declare this my last will and testament, as follows:- FIRST:- I direct that at my death all of my just debts and funeral expenses be first paid of my personal estate. Second:- I give and bequeath to my brother James F. Crawford, the sum of Five Hundred ($500.00) Dollars, in case he shall survive me, but if not, then said sum shall remain as part of my general estate before any division as hereinafter provided, the same as if this bequest had not been made. Third:- I give and bequeath to my beloved wife, Anna Ella Crawford the sum of Two Thousand ($2000.00) Dollars, to be paid out of my general estate before any division hereinafter provided. Fourth:-After satisfaction of provisions First, Second and Third hereof, I direct that my said wife shall receive, and I hereby give, devise and bequeath to her one-half (1/2) of all of the remainder of my estate, real, personal and mixed, of every character. Fifth:- Out of the other one-half (1/2) of my estate remaining. after the above provisions hereof have been taken care of, and before any divisions of the said remaining half in this paragraph mentioned shall have been made, I give and bequeath to my grand-daughter Oma D. Harris and my grandson, Louis Hoyt Brown, son of my deceased daughter Clara D. Brown. Sixth:-It is my suggestion to my said wife that she take as part of her share as above provided, my quarter-section of land located in Section Twenty-six (26) in Township Twenty-Eight (28) South, of Range One (1), east of the Sixth P.M., in Sedgwick County, Kansas, taking the same at Sixteen Thousand Dollars, and in case she does take the same she shall be treated as having received Sixteen Thousand Dollars in value of my estate, and such taking, election and acceptance of this suggestion shall be binding on all persons mentioned herein, as to value and title to said land. This suggestion is not to be taken as binding on my said wife, and in either case she shall file in Court her election to adopt or reject this suggestion, and her failure to file such election shall be treated as an adoption of this suggestion. In case of such failure or in case of her filing an election to adopt this suggestion she shall thereupon become vested with the entire title to said land, free and clear of any title or claim of any other person whomsoever, and shall be charged with having received Sixteen Thousand Dollars of my estate. In case of her rejection of this suggestion said land shall remain a part of my general estate in the hands of my executor. Seventh:- I hereby nominate and appoint my friend C. Q. Chandler, of Wichita, Sedgwick County, Kansas, to be executor of this my last will and testament, upon giving proper bond, and I direct that he settle said estate as expeditiously as possible; and I also suggest that in so doing he advise and confer with my said wife and my said brother James F. Crawford. In case my said wife rejects my suggestion in paragraph Sixth, concerning said real estate, I hereby direct, authorize and empower said executor to sell such real estate, and authorize and empower him to make and deliver proper deed of conveyance thereto to convey the entire title thereto. Crawford, Deceased } In the Probate Court of said County and State The State of Kansas, to Whom these Presents shall come, Greeting: WHEREAS, It appearing to said Court that Belle Kemp, N. Crawford & Seward I. Field witnesses to an instrument of writing purporting to be the Last Will and Testament of William D. Crawford, deceased, which instrument of writing is annexed hereto, now resides at Medicine Lodge, Barber County, State of Kansas, the same being without the jurisdiction of the Court: THEREFORE, KNOW YE, That we hereby empower you, S. P. Garrison, Judge and ex-officio Clerk of the Probate Court in and for the County of Barber and State aforesaid, to cause and come before you, at the time and place to be by you appointed, Belle Kemp, N. Crawford and Seward I. Field, attesting witnesses to the annexed instrument of writing, purporting to be the Last Will and Testament of William D. Crawford, deceased, and to then and there examined them, the said Belle Kemp, N. Crawford, and Seward I. Field, on oath, touching their knowledge of the execution of said instrument, and of the condition of the mind of the said William D. Crawford at the time of the execution and publication of the same as his Last Will and Testament. The examination thus taken you will reduce to writing, and cause the same to be subscribed and sworn to by the said Belle Kemp, N. Crawford & Seward I. Field, and thereupon you shall certify the same, under your hand and official seal, to the undersigned, Probate Judge of said county. Field of lawful age being by me duly sworn, upon their respective oaths in open Court depose and say, that they were present at the execution of the Last Will and Testament of William D. Crawford now deceased, and that they saw him sign the same as Testator, and that they signed the same as witnesses, at his request and in his presence, and in the presence of each other. That at the time of executing the same, the said William D. Crawford was of lawful age and of sound mind and memory, and not under any restraint, and that the Testator well knew the contents of said Last Will at the time of signing the same, and that he signed the same then and there as and for his Last Will and Testament and that the instrument now shown to us is the identical instrument so executed as aforesaid. Field appeared before me on the 25th day of April 1913, and that the said witnesses being first duly cautioned and sworn to make true answers concerning the execution and authenticity of instrument of writing hereto attached, did make answer to the foregoing questions, as the foregoing appears, and did sign and acknowledge the same to be their testimony concerning the authenticity and attestation of the attached instrument, marked Exhibit "AA, as being the Last Will and Testament of William D. In the Matter of the Election of the Widow in the Estate of Wm.. D. Crawford deceased. I, Anna Ella Crawford widow of Wm D. Crawford, deceased, do now appear in open Court for the purpose of making my election concerning the will of my late husband Wm D. Crawford. And the court having fully explained the provisions of said will and my rights under the same, and having fully explained my rights under the Laws of Descent and Distribution, and being fully advised, I do hereby elect to take under the will subject to the conditions and provisions of an election this day filed in connection herewith Anna Ella Crawford Widow IN THE PROBATE COURT OF SEDGWICK COUNTY, KANSAS. IN THE MATTER OF THE ESTATE OF WILLIAM D. CRAWFORD Now comes Anna E. Crawford, widow of William D. Crawford, and accepts under the will of the said William D. Crawford, but elects to reject the suggestion made by the said William D. Crawford in relation to her taking the quarter section of land located in sec. Twenty-six (26), Township Twenty-eight (28) South Range One east of the Sixth P. M., Sedgwick County, Kansas, for the sum of Sixteen Thousand ($16,000.00) Dollars and now files her election to reject the suggestion contained in said will and elects to take under said will said sum of Two Thousand ($2000.00) Dollars mentioned in paragraph Three of said will, and elects to take one half of all other property mentioned and described in said will and declines and rejects the suggestion to take as a portion of her said one half of said property, said Quarter-section at Sixteen Thousand ($16,000.00) Dollars and rejects the suggestion contained in paragraph six of said will. Nothing herein shall waive the right of Anna E. Crawford to the money now in certificates of deposit in the name of Anna E. Crawford and William D. Crawford, said Anna E. Crawford claiming in addition to that mentioned in the will, as her separate property, one half of all money deposited in the banks by the said William D. Crawford and Anna E. Crawford in their joint name, said money being the property of Anna E. Crawford and William D. Crawford, and said Anna E.
