Grandy Deputy This Indenture Made this 26th day of January A.D. 1888 between Samuel S. Cruse and Jane P. Cruse husband and wife of Stafford County, in the State of Kansas of the first part, and Robert L. Milton of Stafford County, in the State of Kansas of the second part: Witnesseth, That said parties of the first part, in consideration of the sum of eleven Hundred and no/100 DOLLARS, the receipt of which is hereby acknowledged, does by these presents, grant, bargain, sell, and convey unto the said parties of the second part, his heirs and assigns, all the following described REAL ESTATE, situated in the County of Stafford and State of Kansas, to wit: The South one half (1/2) of the south west one fourth (1/4) of Section Twenty Nine (29) Township Twenty Four (24) South of Range Twelve (12) West containing Eighty (80) acres more or less. To Have and to hold the Same, Together with all and singular the tenements, hereditaments, and appurtenances thereunto belonging, or in anywise appertaining, forever: And said Samuel S. Cruse and Jane P. Cruse Husband and Wife for themselves their heirs, executors, or administrators, does hereby covenant, promise, and agree to and with said parties of the second part that at the delivery of these presents they are lawfully seized their own right, of an absolute and indefeasible estate of inheritance, in fee simple, of and in all and singular the above granted and described premises, with the appurtenances; that the same are free, clear, discharged, and unencumbered, of and from all former and other grants, titles, charges, estates, judgments, taxes, assessments and incumbrances, of what nature of kind soever; Except one Realty Mortgage drawn in favor of the Kansas Security and Trust Company for Four Hundred and fifty dollars which mortgage is hereby assumed by the said Robert L. Milton and which he agrees to pay; and that they will Warrant and Forever Defend the same unto said party of the second part, his heirs and assigns, against said parties of the first part their heirs, and all and every person or persons whomsoever, lawfully claiming or to claim the same. In Witness Whereof, the said parties of the first part have hereunto their hands the day and year first above written. Samuel S. Cruse Jane P. Cruse State of Kansas, Stafford County, SS. Be it Remembered that this 26th day of January A.D. 1888, before me the undersigned, a Justice of the Peace in and for the County and State aforesaid, came Samuel S. Cruse Husband of Jane P. Cruse who is personally known to me to be the same person who executed the within instrument of writing, and such person has duly acknowledged the execution of the same.
