Buck, deceased } Petition for Probate of Will Comes now Margaret M. Buck and respectfully represents to said probate Court that Napoleon B. Buck, late of the County of Woodson, State of Kansas, departed this life on the 30th day of December A. D. 1893, leaving a last will and testament which said last will and testament is hereto attached, marked "Exhibit A" and maded a part hereof. That said last will and testament has been executed in all respects according to law. And your petitioner further says that the said Napoleon B. Buck left surviving him as his heirs at law Margaret M. Buck, his widow of Toronto, Kansas, age 47 years: Edward N. Buck, his son, of Needles, Cal. aged 29 years; Charles A. Buck, his son of Needles, Cal, age 27 years; Laura E. Taylor, his daughter, of Kansas City, Mo., age 23 years; and Lydia A. Buck, his daughter of Toronto, Kansas, age 14 years. And your petitioner further says that at the time of the execution of said last will and testament said Napoleon B. Buck was of sound mind and memory and not under any restraints. That in said last wil and testament the said Napoeon B. Buck appointed as executrix of the same Margaret M. Buck, of Woodson county, Kansas. In consideration whereof and to the end that said will may be proved, established, performed and admitted to probate, your petitioner prays that the Court set a time for the hearing of said petition and that upon such hearing said last will and testament may be duly admitted to probate and letters testamentary be issued to Margaret M. Buck as executrix of said last will and testament of Napoleon B. Buck deceased. Margaret M. Buck Page 50 State of Kansas, Woodson County, s n? Margaret M. Buck, of lawful age, being duly sworn, upon oath says that she signed the foregoing petition: that she knows the contents thereof and that all the statements therein contained are true. Margaret M. Buck Subscribed and sworn to before me this 6th day of January, A D. 1894 A. J. Jones Probate Judge "Exhibit A. " I, Napoleon B. Buck of the city of Toronto in the County of Woodson and State of Kansas, being in sound mind and memory and understanding do make and declare this my last will and testament. I bequeath all my real and personal estate and effects whatsoever and wheresoever unto my wife, Margarert M. Buck, her heirs, administrators and assigns to and for her and their absolute use and benefit subject only to the payment of my just debts and funeral expenses. I appoint my said wife executrix of this my last wil and testamenet. My will is that my said wife shall not be required to give any bonds or security for the faithful execution of the duties of executrix. And now on this 6th day of January A. D. 1894, comes Henry Coburn who, being first duly sworn, upon his oath saith: My name is Henry Coburn, my residence is Toronto, Kansas, my age is 53 years: I was acquainted with Napoleon B. Buck, a resident of Woodson County, Kansas, about five years in his life time; I was present at Mr. A. B. Mann's office in Toronto, Kansas on or about the 20th day of February A. D. 1891, and I am not posiitive whether I saw the said Napoleon B. Buck, sign the foregoing instrument of writing purporting to be the last will and testament of the said Napoleon B. Buck, but I heard him publish, declare and acknowledge the same to be his last will and testament, and at his request and in his presence and in the presence of A. B. Mann. I signed said instrument as a subscribing witness thereto, and the said A. B. Mann at the request of said Napoleon B. Buck, and in his presence and in my presence signed said instrument as a subscribing witness thereto. At the time of signing said instrument, said Napoleon B. Buck was about 54 years of age; he was of sound mind and memory, and was not under any retraint or under influence whatever. Said Napoleon B. Buck is now dead; he departed this life on the 30th day of December A. D. 1893. Henry Coburn Subscribed and sworn to before me this 6th day of January A. D. 1894 A. J. Jones Probate Judge Also comes A. B. Mann of lawful age, who being first duly sworn on his oath saith: my name is A. B. Mann, my residence is Toronto, Kansas, my age is 54 years; I was acquainted with Page 52 Napoleon B. And the said Henry Coburn at the request of said Napoleon B. Buck and in his presence and in my presence signed the same as a subscribing witness thereto. At the time of signing said instrument said Napoleon B. Buck was about 53 years of age, he was of sound mind and memory and was not under any restraint or undue influence whatever. Said Napoleon B. Buck, deceased, having had fully explained to hereby said Court the provision of the last will and testament of her deceased husband, and her rights under the same, and also the provisions of the law concerning d???? and distribution, and her rights under said law in the event of her refusal to take under the will, and being fully advised and informed in the pre?????, hereby elects to take under the said last will and testament.
