State of Kentucky, Jefferson County. On this 29 day if September, A.D. one thousand eight hundred and Seventy Nine personally appeared before me, Clerk of the County Court, a court of record within and for the County and State aforesaid, Joseph Russell aged 39 years, a residnet of the City of Louisville county of Jefferson State of Kentucky who, being duly sworn according to the law, declares that he is the identical Joseph Russell who was ENROLLED on the 12th day of August, 1861, in Company "A" of the 3rd Regiment of Ky. Infty., Vols. Commanded by Capt. Samuel McKee and was honorably DISCHARGED at Louisville, Ky. on the 13th day of October, 1864; that his personal description is as follows: Age 39 years; height 5 feet 6 inches; complexion Dark; eyes Brown; Hair Dark. That while a member of the organization aforesaid, in the service and in the line of his duty at Battle of Chickamauga in the state of Georgia on or about the 20th day of September 1863, he was wounded by a gun shot in the right shoulder. He was again wounded by a gun shot in the same right shoulder during the siege of Kennesaw Mountain Georgia on or about the 20th day of June 1864 while engaged in battle. The latter wound is the severest wound, and he has been continuously disabled in his right shoulder and arm by reason of said wounds. At times he is so disabled as to be unable to write with his right hand. That he was treated in hospitals as follows: His first wound was treated by the surgeon of the Reg't. He was not treated in hospital for his first wound. For the wound he received at Kennesaw Mountain he was treated in officers hospital at Look Out Mountain near Chattanooga Tenn., where he remained around one month. He was then given a leave of absence home. That he has not been employed in the military or naval service otherwise than as stated above. He never was in any other service that [sic] in Co. A. 3rd Reg't. Ky. Cols. Was a 1st Lieut. when he was wounded at Kennesaw Mountain. That since leaving the service this applicant has resided in the City of Louisville in the State of Kentucky and his occupation has been that of a salesman. That prior to his entry into the service above named he was a man of good, sound physical health, being when enrolled a farmer. That he is now 3/4 disabled from obtaining his subsistence by manual labor, by reason of his injuries above described, received in the service of the United States, and he therefore makes this declaration for the purpose of being placed on the Invalid Pension Roll of the United States. He hereby appoints, with full power of substitution and revocation, H.M. Carr, of the City of Louisville, State of Kentucky, his true and lawful attorney to prosecute his claim. Walnut St. Claimant's Signature, Joseph Russell GENERAL AFFIDAVIT State of Kentucky, County of Adair, ss: In the matter of claim for increase of pension of Joseph Russell late of Co. A. 3rd Regt. Ky. Col. Inf. On this 2 day of April, A.D. 1906, personally appeared before me County Court Clerk in and for the aforesaid County, duly authorized to administer oaths William N.C. Monday aged 77 years, a resident of Knifley in the County of Adair, and State of Kentucky whose Post-office address is Knifley, Adair County, Ky. well known to be reputable and entitled to credit, and who, being duly sworn, declared in relation to aforesaid case as follows: affiant enlisted from same county with claimant and was quite intimate with him during his turn of service while in war, and remembers distinctly of claimant suffering a number of times with rheumatism, while in said service. He says that just after the battle of Stone River in January 1863 while in Murfreesboro camp said Russell was so lame from rheumatism he could hardly walk, that it had been muddy and rainy and wet and the regiment had been without tents and had been compelled to sleep in the mud and cold with no protection. He says he remembers one time at Tuscumbia, Ala., that said Russell was so crippled with rheumatism he had to be hauled in the ambulance. He frequently heard him complain of the rheumatism at other times and noticed he was often lame from it while in said service. Affiant has met with Russell three or four times per year on average since muster out and upon inquiry by affiant as to his health has nearly always complained of the rheumatism clear up to the present time. He further declares that he has no interest in said case and is not concerned in its prosecution. M.S. Stults William N.C. Monday Signature of Affiant War Department Adjutant General's Office Washington, D.C., March 22, 1881 Sir: I have the honor to acknowledge the receipt from your Office of application for Pension No. 313,295, and to return it herewith, with such information as is furnished by the files of this Office. It appears from the Rolls on file in this Office that Joseph Russell was enrolled on the 12th day of Aug., 1861, at Camp Dick Robinson, in Co. "A" 3rd Regiment of Ky. Inf. Volunteers, to serve 3 years or during the war, and mustered into service as a 1st Sergt. On the Muster Roll of Co. "A" of that Regiment, for the months of Sept. & Oct., 1863, he is reported Present for Duty. To Dec. 31/63, Absent on Rect'g Service, since Nov. 23/63. Same to Feby. 29/64. April 30/64, Present. He was discharged to date May 7/64 by S.O. No. 95, Hd. Qtrs. 4th A.C., for promotion to 1st. Lieut. same Co. and Regt. Co. M.O. Roll reports him wounded at Chickamauga. Co. was in action there Sept. 19 & 20/63. Regt. Return for Sept. 1863 does not account for absent enlisted men by name. Records on file furnish no evidence of wound Sept. 1863, as alleged. DEPARTMENT OF THE INTERIOR BUREAU OF PENSIONS Washington, D.C., Sept. 4, 1901 Respectfully referred to the Chief of the Record and Pension Office, War Department, requesting a full military and medical history of the soldier with age at date of enlistment. Record and Pension Office War Department Washington, Sept. 5, 1901 Respectfully returned to the COMMISSIONER OF PENSIONS with the information that in the case of Joseph Russell, Age 21, Capt. McKee's Co. A, 1st Ky. Vols. Designation changed to 3rd Ky. Inf. (November 6, 1861). Roll to Oct.31.61 pres. or absent not stated, same to Feb. 29/62; Oct. 31.62. (Next on file) present, same to Aug. 31. 63. Also found as Joseph. Military records furnish nothing add'l. to above and former (?) reports. Medical Records that have been indexed (or discovered) since the report of Nov. 8/81 was made show the following additional information: treated as Joseph Russell 1 Lieut., Co. A, 3rd Ky June 21 to 26/64. Wound rt. Shoulder, flesh; June 27-28/64. G.I. Wa. Lt. Shoulder. Flesh; & June 28 to July 11/64 G.I. W. right shoulder on leave July 11/64. A medical certificate on which to ground an application for leave of absence, dated July 7/64 shows him suffering from the effect of gun shot wound of the left shoulder received in action June 21/64, the ball entered the posterior part of the shoulder and made its exit four inches distant just below the spine of the scapula without injuring the bone. Act of June 27, 1890, as amended by act of May 9, 1900 DECLARATION FOR WIDOW'S PENSION State of Kentucky County of Adair On this 2nd day of July, A.D. one thousand nine hundred and Six personally appeared before me, a County Clerk within and for the county and State aforesaid, Susan Russell, aged 58 years, a resident of Columbia, County of Adair State of Kentucky, who, being duly sworn according to law, makes the following declaration in order to obtain pension under the provisions of the act of Congress approved June 27, 1890, as amended by yhe act of May 9, 1900. That she is the widow of Joseph Russell, who was commissioned under the name of Joseph Russell at Ackworth, Ga on the 8th of May, 1864 as a 1st Lieut. in Co. A 3rd Ky. Inf. Having been a sergeant, and honorably discharged Oct. 13, 1864, having served ninety days or more during the late war of the rebellion. That the soldier was not in the military or naval service of the United States except as stated above. Said solider first enlisted as a sergeant in said company at Camp Dick Robinson about October 8, 1861 and was afterward promoted as 1st Lieut. aforesaid . That she was married under the name of Susan Frisbie to said soldier at Louisville, Ky on the 1st day of May, 1866, by John L. McKee; that there was no legal barrier to the marriage; that she had not been previously married; that the soldier had not been previously married. That the solider died June 8th, 1906, at Columbia, Adair Co., Ky, that she was not divorced from him; that she has not remarried since his death; and that she is without other means of support than her daily labor and an actual net income not exceeding two hundred and fifty dollars per year. That the said soldier left no children who are now living and under sixteen years of age. That she has not heretofore applied for pension. That she hereby appoints Thomas A. Murrell of Columbia, Ky. her true and lawful attorney, to prosecute this claim. That her Post-office address is Columbia, County of Adair, State of Ky.
