Wills; Adair County KY Robert FLETCHER 11-Dec-1847 Submitted By: Johnnie (Fletcher) Yelvington Submission Date: 25-Jun-2002 I, Robert FLETCHER, of the County of Adair and State of Kentucky do make, ordain and publish this to be my last will and testament hereby revoking and disallowing all others or any other testimony written by me heretofore made, and establishing this and no other to by my last will and testament. The property that I have heretofore given to my daughters, Margaret PROWELL and Leeorista WALKER and my son Green FLETCHER, deseased is their share & portion of my estate which gifts are here confirmed. I give the use, occupation and benefit of the tract of land which includes the house and farm on which I now live containing one hundred and fifty acres to my son Silas FLETCHER and his wife during their lives and after the death of each of them I give and devise the said one hundred and fifty acres of land to my two grandsons, Robert FLETCHER and William FLETCHER, sons of said Silas FLETCHER and if said Silas FLETCHER and his wife should at any time choose to leave the land and move away said tract of land and the farm shall be rented by my executor but not for a longer time than one year at a time and to no person to live on the land or any part of it and no timber is to be used for any purpose whatever except to keep up fencing and buildings, the rent to be assigned exclusively for the benefit of said Silas FLETCHER & wife. I give to my son John H. FLETCHER and his wife, Malinda, the use and occupation of the residue of my tract of land which is the part that Silas FLETCHER now lives on during their lives and the lives of their survivors and if the said John H. FLETCHER should hereafter have legal issue then I give and devise said tract of land to such children or heirs after the deceased of John H. FLETCHER and his wife ----- should have as much of said John H. FLETCHER and his wife should have ------ or heirs -----said tract of land ----- of said John H. FLETCHER and his wife ----- including the house and all the cleared land on said land running with HAMILTON's line on one end and side thence to the Glasgow road and down it to the beginning to include about forty acres which piece or parcel of land John H. FLETCHER and wife may sell and convey if they choose. The residue of said tract shall constitute a part of my home tract, which I give and devise to said Robert and William under the same restrictions and qualifications contained in the devise to them of my home tract. I give and devise to my son Lewis FLETCHER my Negro man, Toby. I give and devise to Malinda, the wife of John H. FLETCHER, my Negro girl, Elizabeth, if she should not survive her husband, John H. FLETCHER, and if she should not survive him then I give and devise said girl, Elizabeth, to my granddaughter, Elizabeth FLETCHER, daughter of Silas FLETCHER. I give and devise the use and service of my Negro woman, Gelina, and her child, George, and the future increase if any of said Gelina, to my son Silas FLETCHER and his wife during their lives and the life of the survivors and after the death of said Silas FLETCHER and his wife, said Gelina and George and the increase if any shall be sold and the money equally divided among the children of Silas FLETCHER except Robert and William FLETCHER. I give to John H. FLETCHER and Silas FLETCHER the use and services of my Negro man, Charles, Silas to have the use and service of two thirds of his time and John FLETCHER one third and if Charles at any time become unruly and unmanageable then my executor shall sell him and place the money at interest and the interest is to be applied to the use and benefit of said John H. and Silas FLETCHER in the same proportion as his services. All the money and cash notes that I may have at my death is to be put and placed in good safe hands at interest by my executor and the interest to be appropriate and expended alone on the education of Silas FLETCHER's children until the youngest is educated and when the youngest shall become of age then all the money to be equally divided among said children except Robert and William FLETCHER. After the death of John H. FLETCHER and Silas FLETCHER, my Negro man, Charles, is to be sold if my executor should not sell him before and the money arising from said sale whether sold before or after their death is to be equally divided among Silas FLETCHER's children except Robert and William. One half of my stock of horses, cattle, hogs and sheep are to be sold at my death and two thirds of the remainder of each I give to Silas FLETCHER and one third to John FLETCHER, my wagon and one cart and oxen is to be left on the place for the use of John H. & Silas FLETCHER and my black smiths tools are to be rented out for their joint use. I give to my two grandsons, Lewis FLETCHER and Seth FLETCHER and granddaughter, Elizabeth FLETCHER, one bed and furniture each. It is my will that one half acre of land including the grave yard, the graves to be in or near the center I devise to no person. It is my will that it be kept and used for the purpose of nurturing the dead and for that purpose only. All the rest and residue of my property, if there should be any not herein devised, I direct to be sold and the money to be applied as I have directed the money and cash notes to be used and applied. I will that John H. FLETCHER have the use and benefit of one thirds of the meadow on the farm I now live on as long and as he may want. And lastly I do appoint my friend, Mathew WALKUP, my executor to be allowed and carry out the provisions of this my last will and testament and I do request my friend Parker HARDIN to advise and counsel with my executor and those that may be interested in this will whenever it may be necessary. C. HARDIN & S. G. SUDDARTH subscribing witness thereto and ordered to be recorded and Mathew WALKUP, the executor therein named, having in person refused to qualify.
