Hiser will In the name of God Amen. I John Hiser of the county of Barren, being & weak in body but of sound mind & disposing memory for which I think God, but knowing the uncertainty of human life and being desirous to dispose of such worldly goods as it has been pleased God to bless me with I make this my last Will & testament in words following that is to say first. I desire my Executors herein after named to sell immediately after my decease all of or as much of my perishable property as will pay all of my just debts & payment be made 2nd I will and bequeath to my beloved Wife Sarah Hiser all & Singularly the remaining balance of my estate consisting as follows that is to say the Survey & farm on which I now live containing by Survey one hundred & fifty acres. All my Stock of Horses Cattle Sheep & Hogs also all of the money due to me from the United States which stand in the books of the Treasury of the War department also all the money due me from the Commonwealth of Kentucky which stand in the books of the Treasury of the Commonwealth of Ky & all other property belonging to me that may not be herein named. I give to my beloved wife to have and to hold for her use throughout her natural widowhood life if my beloved wife after my decease should see proper to & join wedlock matrimony I then desire my Executors to immediately Sell all my property and divide the monies arising from Such Sale between my bloved children herein after named as though my beloved wife had deceased, but if my beloved wife should live throughout her natural life a widow at her decease I desire my Executors to immediately after her decease to sell all my property that She may leave & divide the monies arising from Such Sale equally between my Ten Children hereinafter named namily Benjamin Hiser Jacob Hiser Elizabeth Jewell wife of Robt. Jewell Isaac Hiser Reuben Hiser the heirs of Rachael Faulkner wife of John Faulkner Aaron Hiser Mary Lisle wife of James Lile Rebecca Jewell wife of John Jewell Phebea Jewell wife of Elija Jewell all to have an equal portion of the monies arising from the Sale as above stated & my further will is that if my executors should after my decease find that I have money on hand sufficient to pay all my just debts that they take such money and pay such debts & for none of my property to be sold but to remain with my beloved wife as before named and now I do ordain & appoint my beloved son Benjamin Hiser & my trusty friend Isaac Wilcoxen my Executors to sell and distribute my property & to divide & to divide the monies arising from such sale equally between my Ten Children before named In witness whereof I set my hand & Seal in the presence of those witnesses whose names stand here annexed this the Sixteenth day of February in the year of Our lord One thousand eight hundred and thirty nine his Teste John X Hiser {Seal} William Ratliff {Seal} mark Reuben Hiser {Seal} his John X Faulkner {Seal} mark John Jewell {Seal} Barren County April terms 1839 The foregoing writing purporting to be the last will of John Hiser was produced in court & proven in due form of law by the Oath of Reuben Hiser & John Faulkner subscribing witnesses thereto to be the true last will & testament of said John Hiser decd whereupon the same was ordered to be recorded Att TJ Helm C.B.C.C.
