DEED: Commissioners to Charles Corbin et al, 1871, Bath Co Submitted by: Smith, Elizabeth (ESmith@Montgomery.k12.ky.us) Date: Tuesday, May 5, 1998 Bath Co., KY, Deed Book 27, Pages 349 Whereas, in the action of Aaron Garrett & others, Heirs of Fleming Garrett Dec'd Plaintifs, against America Garrett (his widow) Defendant, then pending in the Bath County Court, an order was made at the March Term, 1869 directing Thomas N. Flood, A N Crooks & James Ewing Commissioners of said Court to divide and allot the lands named in said Plaintiff's Petition. And Whereas, said lands were divided in accordance with said order, and there was allotted by said Commissioners to Charles Corbin, Mary C. Corbin, Taylor Corbin, William Corbin and Elizabeth Corbin Lot No. 1 described as follows, viz: Beginning at a stake in Mrs McIlvain's line, Thence S. 3/4.W.22. poles to a stake in said line. Thence E.42.24. poles to a stake in Botts line, Thence N.27 1/2.W.24.6 poles with said line to a stake. Thence W 30.56.poles to the beginning. Containing Five acres. And Whereas, the report of said division was confirmed by said Court at the May Term, 1869 and by a further order then made, the undersigned was appointed Commissioner, and directed to execute a Deed of Conveyance of said land described as Lot No. 1 to said Charles Corbin, Mary C. Corbin, Taylor Corbin, William Corbin and Elizabeth Corbin. Now, Therefore, This Indenture, made and entered into this 9th day of January, 1871 between Aaron Garrett, David Garrett, Richard Garrett, Uriah Williams, Catherine Williams, Henry Garrett, Martin Jones, Martha Jones, Richard Miller, Julia A Miller, Ann Eliza Scott, Joseph Conner, Fanny Scott Conner, George Corbin and America Garrett by R Gudgill Special Commissioner aforesaid of the first part and Charles Corbin, Mary C. Corbin, Taylor Corbin, William Corbin and Elizabeth Corbin of the second part. Witnesseth, that for and in Consideration of the premises, and in obedience to said order, parties of the first part, by R. Gudgill Special Commissioner aforesaid, have sold, and do hereby convey to each said parties of the second part their heirs and assigns forever, the Lot of land above described To Have and to Hold said Land with all the appurtenances thereunto belonging unto the parties of the Second part and their heirs and assigns forever. The parties of the first part by said R. Gudgill Commissioner aforesaid hereby Covenant with the parties of the Second part that they warrant and defend the Title to the Land and premises Conveyed against the claims of all persons claiming by through or under them and this Certificate hath been duly recorded Given under my hand this 9th day of January 1871.
