DEED: Cartmale [Cartmill] to Cartmale, 1853, Bath Co File submitted by: Paula Berry Hampton, I have copied the following deed from Bath County Deed Book U Page 665. Mary Hamilton being my second greatgrandmother and David M. Cartmill being my third greatgrandfather. ===================================================================== Cartmill deed, Bath Co KY, 1853 "This indenture made and entered into this 23rd day of September 1853 by and between William Cartmale, Eliza Cartmale, Sally Cartmale, Mary Hicklin Cartmale, Frances Cartmale, Sarah Blackburn and Charles Blackburn, Dennis A. Peyton(Daniel), ___Reed(Aninias) husband of Sally Cartmale, James Payne, husband of Eliza, late Eliza Cartmale, heirs at law of David Cartmale together with Nancy Ann Cartmale, widow of the said David Cartmale, deceased by Stephen Farrow Commissioner, under a decree of the Bath County Circuit Court, at its present September in the case of Thomas F. Hazelrigg, Plaintiff against John Cartmale vc, of the one part, and John Cartmale of the second part witnesseth that the said parties of the first part by the commissioner aforesaid in consideration of the decree aforesaid and the sum of one dollar to said commissoner in hand paid the receipt of which is hereby acknowledged hath granted and conveyed and doth by these presents grant, bargain and convey in partition to the said John Cartmale the following lot of land situated and lying in said County of Bath on the waters of Slate Creek and bounded as follows to wit: Beginning at J in the plat of division filed in the papers of said chancery proceeding aforesaid by the Commissioner a point in the branch thence S 18 degrees W 34 poles to C on said plat a boxelder and hackberry thence N 55 W 16.4 poles to D on said plat a white oak, thence S 84 poles to E on said plat a white oak, thence N 87 E 15.7 poles to F a white oak, thence S 60 E 15 poles to a beech at H on said plat, thence N 116 poles to the beginning containing fourteen acres said lot of land is divided as follows by said Commissioner appointed to divide said lands. To wit: 7 acres 1 rood and 16 poles allotted to said John Cartmale in his own right as heir at law of said David Cartmale, decd, and three ninths obtained by purchase of the aforesaid William H. Cartmale, ___(Aninias)Reed and Sally his wife and H.(Hugh Hicklin)Cartmale heirs at law of said David Cartmale, decd, which added to the share aforesaid makes 10 acres 2 roods and 28 poles and said lot also contains 3 acres 1 rood and 12 poles being four ninths of one tenth belonging to the heirs of Margaret Blackburn deceased as heirs of David Cartmale and Thomas Cartmale and Mary Hamilton also heirs at law of David Cartmale deceased making the whole lot contain 14 acres. To have and to hold the same with all its premises and appurtinances to him the said John Cartmale his heirs vc forever free from the claim or claims of the said heirs aforesaid. And the said parties of the first part together with said John Cartmale do here by these presents sell grant and convey for the consideration aforesaid to William M. Thompson the following lot of land situate and lying as aforesaid and bounded as follows to wit: Beginning at the letter H on the plat aforesaid a beech corner to lot No 1 thence S 60 E 55 poles to a stake in a hollow thence down the same N 70 degrees E 10 poles S 76 E 6.7 poles to K a small elm corner to lot No 9 thence N 3 degrees 36 W 121.3 poles at L on the plat a stake in the bank of Slate thence down the same where it meanders to B on the plat a sycamore Bondurants? corner at the mouth of a branch thence up said branch S 45 W 11 poles S 18 W 30 poles to J on the plat a stake corner to lot No 1 thence S 116 poles to the beginning containing fifty acres, 2 roods and 25 poles. To have and to hold the same together with all and singular its premises and appurtinances unto the said Thompson his heirs vc forever free from the claim or claims of said parties. And the said parties of the first part do by the Commissioner aforesaid grant bargain and convey to Frances Peyton, wife of Daniel Peyton, late Frances Cartmale, the following lot and parcel of land situate and lying and being as aforesaid and bounds as follows to wit: Beginning at the letter X on the plat a stake on the bank of Slate Creek thence S 3 degrees 36 E 121.3 poles to H an elm thence S 76 degrees E 12 poles to a stake corner to the Dower, thence N 1 degree W 112 poles to a stake thence N 61 degrees W 21 poles to a blue ash the beginning, containing 10 acres 3 roods and 2 poles. To have and to hold the same with its premises and appurtinances to the said Frances Peyton her heirs and assigns forever free from the claim or claims of the heirs aforesaid and the said parties first above enumerated, doth and will by these presents and by the Commissioner aforesaid their right and title to the several lots of land herein conveyed forever, warrant and defend against the claim or claims of themselves their heirs vc but not against the claim or claims of any other person as the warranty aforesaid is only intended to be as directed in the decree aforesaid. And it is understood that the Commissioner herein is in no event to be personally responsible on the warranties aforesaid herein in testimony whereof the said parties of this deed have hereunto set their hands and seals the day and date above written. Turner, Jr. Clerk of the Court for the County and Circuit aforesaid do certify that the foregoing deed of conveyance from S.F. Farrow Commissioner of this Court to John Cartmill, William M. Thompson and Frances Peyton was produced in open Court on the 23rd day of September 1853 and acknowledged by the said Farrow as Commissioner to be his act and deed approved by the Court and ordered to be certified to the Clerk of the Bath County Court for record which is hereby accordingly done.
