Bath County KY DEED: Commissioners to Ann E Scott, 1871 Submitted by: Smith, Elizabeth (ESmith@Montgomery.k12.ky.us) Date: Tuesday, May 5, 1998 Bath Co., KY, Deed Book 27, Pages 352-354 Whereas, in the action of Aaron Garrett & others, Heirs of Fleming Garrett Deceased Plaintiffs, against America Garrett (his widow) Defendant, then pending in the Bath County Court, an order was made at the March Term, 1869 directing Thomas N. Flood A N Crooks & James Ewing Commissioners of said Court to divide and allot the lands named in said Plaintiff's Petition. And Whereas, said lands were divided in accordance with said order, and there was allotted by said Commissioners to Ann E. Scott Lot No. 3 discribed as follows, viz: Beginning at a stake in Green's line, Thence with it S 1 1/4 W. 10.12 poles to Stake a corner to lot No. 2. Thence E 81.84 poles to a stake in Botts line and corner to lot No. 2. Thence N 27 1/2 W 8.36 poles to a stake a corner to same. Thence N.24 3/4 W. 3.02. poles to a Stake in line of Same Thence W76.48 poles to the beginning containing five acres And Whereas the report of said division was confirmed by said Court at the May Term 1869 and by a further order then made, the undersigned was appointed Commissioner and directed to execute a Deed of Conveyance of said land described as lot No. 3. to said Ann Eliza Scott. Now, Therefore, This Indenture made and entered into this 9th day of January 1871 between America Garrett Aaron Garrett Richard Garrett Charles Corbin Mary C Corbin, Taylor Corbin William Corbin Eliza Corbin and Fannie Scott Conner by R. Gudgill Special Commissioner aforesaid, of the first part and Ann Eliza Scott of the second part Witnesseth, that for and in consideration of the premises, and in obedience to said order, the parties of the first part by R. Gudgill Special Commissioner, aforesaid, have sold, and do hereby convey to said party of the Second part and her heirs and assigns forever, the Lot of Land above described. To Have and to Hold, said Land with all the appurtenances thereunto belonging unto the party of the second part and her heirs and assigns forever. The party of the first part by said R Gudgill Special Commissioner aforesaid, hereby Covenant with the party of the second part that they will warrant and defend the Title to the Land and premises conveyed against the claims of all persons claiming by through or under them In Testimony Whereas, said Commissioner has hereunto set his name this 9th day of January 1871 R.
