Bath County KY DEED: John Leach to Christopher Oakley et al, 1821 Submitted by: Smith, Elizabeth (ESmith@Montgomery.k12.ky.us) Date: Wednesday, May 13, 1998 Bath Co., KY, Deed Book D, Page 140-141 This Indenture made and Entered into the 27th day of October 1821 Between John Leach of Bath County and State of Kentucky of the One part and Christopher Oakley John Cassaty & James McLain of the same place of the other part witnesseth that for the consideration herein after set forth the said John Leach grants bargains sells & conveys to the said parties of the other part all the tract of Land on which he now lives & which was conveyed to him by James French lying on Slate Creek in said County and Bounded as follows Beginning at a white Oak hickory and Elm N.W. corner to Michael Cloper thence East 70 poles to an Elm on the Bank of Slate Creek thence N 113 W.36 poles to a stake thence N40 E.40 poles to a stake Thence North 74 poles to a white Oak & Blue ash thence S.58 W.100 poles to two Ironwood saplings & sugartree thence S.55 W.146 poles to a stake thence S65 W70 poles to a Buckeye and 2 ash trees thence S.38 poles to three white oaks Corner to Peter Cassity thence S25 E87 1/2 poles to a poplar ash & Sugartree Corner to James McClain thence East 153 poles to a Buckey ash & Elm in John Butler's line thence North 39 1/2 poles to Butler's Corner a buckeye & white Oak thence 87 poles to to two Blue ash Saplings & Red Bud thence North 111 poles to the Beginning containing two hundred and Seventy Eight acres more or less to have and to hold the above land and premises to them the said Oakley Cassity & McClain their heirs and assigns in fee _?_ forever Subject however to the following Consideration & Conditions whereas the said grantees in this deed of Mortgage are the securities & Joint obligors of the --- Leach in 2 notes to the Bank of the Commonwealth of Kentucky payable at their Branch at Mount Sterling for one hundred Dollars each One half of which sum has been discounted & paid to the said leach Now the Object of this conveyance is to indemnify & save harmless the said Oakley Cassity & McClain in consequence of said security & whenever? hereafter the said Debts shall be paid by said Leach to teh said Bank then this deed to be void but otherwise to remain in full force so long as the same or any part thereas? shall remain unpaid & if the said Securities or any one of them shall be compelled to pay any part there of then he or they may enter upon and take possession of said lands & premises until he or they be fully Renumerated & satissfied In witness of which I the said Ledach have hereunto set my hand & seal the day and date above Test John Leach Seal Henry Chiles jr John Slavens Bath County Sct I William M Sudduth Clerk of The Court of the County aforesaid do certify that this Deed of Mortgage from John Leach to Christopher Oakley John Cassity & James McClain was this day acknowledged before me by the said John Leach to be his hand and seal act and Deed for the purposes therein contained where upon the same is truly Recorded in my office as the Law Directs Given under my hand as Clerk aforesaid this 27th day of October 1821 William M.
