Fleming Bath County - April 2, 1842 In the name of God Amen, I George W. Fleming, being of weak in body, but of a sound mind and memory, so make and publish this my last Will and Testament as follows to wit: 1st. I will the use of the lower part of the farm to William H. Fleming, Joshua I. Fleming, Patsy A. Fleming, now the late Patsy A. Hardin, to have and to use rent until such times that the land will sell to advantage. The same is the division line between the upper part and lower part except the south stables, I will to add to the upper part. 2nd. When the times are better for selling the land, I wish the whole of my farm sold and then divided as follows. To wit: First, my wish and desire is that my sons James W. Fleming to have $200.00 for his full portion to be paid by my executor when the land is sold. Should my son not be living to accomplish, the money to go to the child or children. Second, the remainder of money arising from the sale of land to be equally divided between my children, namely Patsy A. Hardin, William H. Fleming, Joshua I. Fleming: I will my interest of a black mare to my four younger children, but not to be sold out the family. I also will my gray mare and colt she will foal to my daughter, Indiana Frances Fleming. Also I will my son Eli W. Fleming a three year old gray colt and it is my will that my daughter Elizabeth S. Fleming is to have a good horse. I further will and Desire that my four youngest children have two cows and all my household furniture if my three children, Patsy A. Fleming, now Hardin, William H. Fleming and Joshua I. Fleming will take the remainder of the personal property and debts owing to me and pay my just debts to have the same. If not willing to do so, my will is that the remainder of personal property to be sold. If it is not sufficient to pay my just debts that the lower part of my farm to be rented until able to pay just debts and expenses. This foregoing Will and Testament I declare to be my last Will and Testament revoking all former Wills made by me and appoint William Hazelrigg (brother-in- law) to be my executor. In testimony thereof I set my hand and seal this 2nd day of April, 1842. Signed, George W. Fleming Signed in the presence of James R. Boardmen and Ignatius Burns. Bath Co. KY June 12, 1843. Proved in open court under the oaths of above witnesses. Signed, Wm. Sudduth, C.C. Bath Co. Appraisal of property amounted to $499.54. Final settlement of estate made by executor William Hazelrigg May 14, 1845. Estate valued at $2668.86. June Court 1843 An instrument of writing purporting to be the last will and testament of George W. Fleming dec'd was produced and proven in open court by the oath of James R. Boardman, Ignatious Burns witness thereto subscribed whereupon the same is ordered to be recorded. On the matters of William W. Hazelrigg the executor in said will named who made oath thereto as the law directs. It is ordered that the probate be granted him in due form of law giving security, whereupon together with James R. Boardman & Eli Hazelrigg be entered into & acknowledged and in the penalty of $6000 conditional according to law. July 1843 Ordered appraisal of estate of George Fleming dec'd.
