Date: Sun, 27 July 2003 Submitted by : Karen Zach kzacho@qserve.net ********************************************************************* Bath County Court - last will & testament -- In the name of God, Amen, I, William Morgan and state of Kentucky being weak in body but sound and disposing of mind and memory do make and publish this my last will and testament in manner and form following: First, after my inst. debts and funeral expenses are paid I give my wife, Sally Morgan, one bay mare and colt, one cow and calf, six sheep, six hogs , one bed and bedding and such articles of household and kitchen furtniture as she shall deem necessary to keep and all that part of my land and farm included in the following boundary: Beginning at the southwest corner of my land to Wilson Hunts and running north with my line and fene to the end of the cross fence that runs across my pasture and continuing an easterly couse with my cross fence to the roa where it crosses the ford branch; thence up the branch to the line between my land and Wm. Stephens; thence with the south line and fence to the beginning. All of which my said wife shall hold and possess for her own use and benefit during her natural life. Secondly, I give to my son James Morgan all that part of my land and farm which he has heretofore occupied for his own use and benefit during the natural life of my wife and all the remaining part of my land and farm not above devised. i leave in the care and control and management of my said son, James to improve repair and keep the same free from being impaired in any way and to use the proceeds thereof for his own benefit during the natural life of my wife and then as soon after the deceas of my wife as circumstances will admit the same together with that part given to my wife and part first given to be sold with all my other landed estate in Kentucky for the best price and divided as herein after directd, and whereas my children have heretofore each of them received some part of my estate, some more and some less, do therefore first give and bequeath to my oldest son $80. I give and bequeath to my daughter, Betsy Roach to her and her heirs forever $20 and all that lot or tract of land lying and bein gin Park (sic) county in the state of Indiana lst being the west half of the southwest quarter of section no. 6 in township no. 17 north of range no.l 6 west containing 85 acres and 98 hundredths. I give to my son William Morgan $60. I give to my daughter Sally Butcher and heir heirs $150. i give to my son Nathaniel Morgan $150 I give to my daughter, Polly Jones and to her heirs forever $60 and all that lot and parcel of land on which she now lives, lying in Park county, in the state of Indiana, it being the west half of the southwest quarter section no. 6 west, it containing 85 acres and 98 hundreds. (abutted Bety Roach's property) I give to my daughter, Lucy Arrasmith $160 I give to my son Ambrose Dudley Morgan $160 All the above mentioned legacies, money to be raised and paid first to each of the legatees out of my estate real and personal. I give and bequeath all the remainin gpart of my estate both real and personal to my ten children above named. to be divided equally among them and their heirs forever. I do hereby nominate and appoint my son Nathaniel Morgan of Indiana trustee for my two daughters, Betsy Roach and Polly Jones to receive hold and secure under his care and control all the estate herein willed and bequeathed to each or either of them or their heirs to direct, govern and manage the whole of their estates to them willed and every part thereof herein given at his direction for the entire use, profit and benefits of the said Betsy Roach and Polly Jones and each of their heirs forever and I do hereby appoint my two sons James Morgan and Nathaniel (James for the Ky. part and Nath. for Parke Co. lands -- Nath. was to oversee his two sisters -- perhaps William did not trust their husbands??) the sole executors of this my last will and testment hereby revoking all former wills by me made. Witness whereof I have hereto set my hand and seal this 24th day of Oct in the year of our Lord One Thousand eight hundred and forty three (almost 7 years before he died) --I, William Morgan of the County of Bath, State of Kentucky do hereby emancipate and set at Liberty my negro man, "Gabriel" from and after the present date in witness whereof I have hereunto set my hand and seal this 12th June, 1837 William Morgan (evidently he did not believe in slavery as this is almost 30 years before he would have been required to set Gabriel free!
