I, James Robbins of Bath County, being weak in body but of a sound disposing mind do make this my last will and testament and hereby revoking all others heretofor made. It is my will and desire that my execution here after to be made shall as so on as consummed after my death pay and discharge all my just debts, funeral expenses out of my personal estate. It is my will and desire that my beloved wife, Mary, shall have the use and control of all my formal estate including my funds and noting for for the use of her and my two afflicted daughters, Sally and Polly, who has been for a long time confined to a bed of sickness to maintain them and pay the doctors bill. It is also my will and desire that should both Sally and Polly both or either get well at the death of their mother, they shall have the balance of their personal estate, including the money and bed. Should they die my wife shall have the use of the same during her life and after her death if any of said formal property should be left the same is to be equally divided between my said children that may be living. It is my will and desire that this land tract that I now come and are living on lying on slate once containing about two hundred acres shall be at my death equally divided and held by my two beloved sons John Robbins and Adrew Robbins as first tenants to be theirs forever with this special request and injunction that they are not to sell their interest in said land witout both consents to the same. They are to allow their mother and two afflicted sisters Polly and Sally to remain and live on the same as long as they live and my two sons John and Andrew is to take care of the them and see that they want for nothing as to my son Joel and my daugters Anna Webster, Peggy Richards, and Rebecca Jones. All of whom I have made some advances to but I direct and bequeath that should all my land be saved and gains and in the law suits made pending for a portion of the said tract of 200 acres then and in that case It is my will and desire that my sons John and Andrew shall pay to Joel Robbins, the some of $250 and to each of my three married daughters Anna Webster, Peggy Richards, and Rebecca Jones each two hundred dollars the first payment of those legaliez to paid at the end of one year after the suit is determined and the land gained and then the said John and Andrew at the end of the year shall pay to each twenty five dollars nad so on at the end of each year they shall receive twenty five dollars each until they shall receive their legiciez but should said lawsuit be lost then the said Joel, Anna, and Rebecca is to have nothing until the death of their mother and two sisters Sally and Polly at which time they ware to have their portion of which remains left of my estate except for the land which is to be absolutely John and Andrews the division to be made among those that may be living at that time but should Polly and Sally either get well and marry they are not to have any portion of my personal estate until the death of their mother unless, their mother may think propper to let them have some articals of stock and household property. Its also my will and desire that there shall be no sale of any sort on of my personal estate unless by the consent of my wife I do hereby appoint my two sons John Robbins and Andrew Robbins executors of this my last will and testament. Given under my hand and seal this 17th day of september 1842. James Robbins seal Signed, sealed and delivered in prescence of A Trumbo and George Coyle James Robbins being still weak but of a sound mind do make this cordicel to my last will and testament. It is my will and desire and direct that should my said personal estate including all my bonds all fail to be sufficient to keep my two sick daughters Sally and Polly until they get well or die and maintain their mother my wife as long as she should live. I then direct my two sons John and Andrew to maintain and take care of them during the sickness of the two girls and during the life of their said mother and its my will and desire that they shall take the demise of the land that is named in my will with that incumberance of taking care care and maintaining their two sisters and mother. Its also my will and desire should there be nothing left of my personal state after the death of my wife and my two daughters Sally and Polly should get well or die then in that case I direct my said executors to pay to Joel Robbins, my son, Anna Webster, Peggy Richards, and Rebecca Jones my three married daughters one dollar each each as their full portion of my estate except what is provided and allowed by last will in case the land is saved and directed to be paid by my two sons John and Andrew Robins. Its also my desire should Polly and Sally or either of them get well and my land all be saved then I direct my two sons Jno and Andrew to pay to each of them two hundred dollars in the same way and at the same time and the same sums I have directed to be paid to my other three married daughters and this is only to be done and paid to them upon the condition that there is nothing left of my personal estate after the death of my wife. I direct my said executors to take charge of my personal estate and use the same in as sparing of condition? many and for the maintainance of my wife and two sick daughters Sally and Polly given under my hand and seal this 25th day of September 1842. James Robbins seal Signed, Sealed and delivered in presence of A Trumbo and E Trumbo Bath County November Court 1842 pg 248 This instrument of writing purportions to be the last will and testament of James Robbins deceased was produced and proven in asses Court by the oaths of Andrew Trumbo and George Coyle witnesses there to subscribed and the concedal then on enclosed was also proven by the Oath of Andrew Trumbo a witness there to subscribed who also proved that Eliza Trumbo the other witness there to subscribed her name as a witness in the presence affect the request of the testator and also was in the presence of A Trumbo and ordered to be recorded where upon the same hath been duly admintted to record in my office as the law directs given under my hand as clerk of the Bath County Court, this 14th day of Nov. 1842.
