SLAVE AND LAND DIVISION OF THE ESTATE OF JACOB WARNER Transcribed by Darrell Warner from the Estate Settlement Book #3 from Bath County, Kentucky pages 165, 166, 167, 168 and 169 The undersigned Commissioners appointed at the last December Term of the Bath County Court to divide the slaves and land of the late Jacob Warner among his and being first duly sworn met on the premises on the day of December 1860 and after adjourning from day to day made and effected the following division to the best of their abilities and judgment as follows towit, Slaves Lot 1 Allotted to Sally McDonald the wife of J.M.. McDonald, a Negro boy named Fielding and a girl names Betty valued at $800 and lot #4 (Jonas Warner) to pay her the sum of sixty four dollars and 25 cents. 2nd To the heirs of Nancy Young deceased, who was the wife of Reuben Young, Negro woman named Aggy and her child Dick valued at $850 and lot #4 Jonas Warner to pay them the sum of $14. 3rd To the heirs of William P. Warner deceased, Negro girl Mary valued at $800 and lot #4 (Jonas Warner) to pay them fifty seven dollars and the heirs of Hetty Whittington who was the wife of (information missing) to pay them $7 4th To Jonas Warner Negro boy Jack $1000 and he to pay out as above stated. 5th To the heirs of Hetty Whittington Negro boy named Step valued at $1000 and they to pay to the heirs of William P. Warner as above stated $7 also to lot 7 (Allen Warner) the sum of $128.75 6th To Margaret Arnold the wife of David Arnold, Negro girl Malinda and her child John valued at $1000 and she to pay lot #7 (Allen Warner) the sum of $135.75 7th To Allen Warner, Negro boy Isaac at $600 and Margaret Arnold as above stated to pay him $135.75 and lot #5 Hetty as above stated to pay him $128.75 making and equal division in seven equal shares valued at $864.25 each. Your commissioners have also made the following division of land of said Warner among his heirs as follows. Warner's heirs thence N88 E4 poles to 1 a Buckeye Sugar & Ash corner to Hughes also aforesaid heirs thence S19 W106.4 to stake side of road near Hughes fence thence S42 W24.4 to Sugar Tree in road to 3 on plat S2-1/2 W25 stake in corner of Hughes fence at S20 W30 to two Sugar Trees in James Ragland's line at 5 on plat thence N88 W35 poles a Sugar Tree at letter E on plat thence N2-3/4 W182 poles to stake at C on plat corner to lot 6 thence N87-3/4 E100.5 poles to beginning 84 acres. All of which is respectfully submitted to the Honorable Bath County Court this 26th day of January 1861 (can't read who signed it) There are two pages of drawing showing how all the land was divided out. State of Kentucky Bath County I R.H. Conner clerk of the County Court for the aforesaid do certify that the division of the land and slaves of Jacob Warner deceased was this day produced in open court approved confirmed and ordered to be recorded.
